In the case mcds the woman was only asking for medical. I think it was 150k max. But mcds and the attorney were so rotten in the courthouse that the jury provided a bonus award.

Generally our courts are juried by our peers. When I see a large sum of an award I tend to think there is much more to the story.

This is why I am scared to death about letting inexperienced people use equipment. It doesn't take long to teach someone to drive a tractor, especially a licensed driver. And everything seems fine. It's what happens when things go wrong that worries me. I've seen some peoples inappropriate reactions or none at all.

That's why I don't allow others to use my equipment. If a neighbor needs help, I'll help 'em and I'll operate the equipment.
In the case being discussed, the plaintiff's lawyers argued a lack of training for a temporary employee. "Lack of training" is a relative term...but I would never allowed anyone near any rotating equipment.

While accidents can happen to anyone, some people simply don't understand working safe. I once saw a worker (not on my place) reach into a baler while it was operating. He said he had his cell phone with him in case he got one hand caught up, he'd dial with the other hand. Serious, that is what he said. He would be an example of Darwinism at it's best.

Some people guide the head with a person on the ground. Some people foolishly use a person on the ground to provide down force. I like the FEL diggers.

Thanks. Will keep this all in mind if I ever get one. May just stick with steel posts and manually drive. We pull them with the back hoe.

I have used my 3 pt phd for 20 years. I don't think you can stop one fast enough to prevent injury. I am surprised he didn't get killed. A lot of guys get killed this way, usually putting in fences. I think the last I heard of was a woman, her husband was on the tractor.

That is why my wife hit me with the showel when I tried to push on the auger.
