The court date was Monday. The guy was already on probation for something else so they gave him a diversion until 1-14-2014. If there are no more incidents during that time they will dismiss the charges. They have another court date for that day to review the case. I'm not really happy with the outcome but I guess it's better than nothing. Maybe at least for the next six months that will keep them quiet.

Probation, so he got away with something else and they are letting him slide on this as well. Is there any wonder why there is little respect for law when a slap on the wrist is all they get. You see it all the time " a rap sheet as long as your arm" well this how they get them. Time to start that drainage ditch and some fencing.

Yep, and I don't recall if you have put up any kind of video surveillance yet Tim, but I definitely would do so if not after this. And you're right, this kind of "law enforcement" is what leads dirtbags to have no fear of breaking the law, especially when "their kind" have been through the system and know how easy it is to work the system.

How do you think a lot of cops feel, knowing they try to curtail certain activities and the perps just keep walking, pretty aggravating all the way around.

As a there may be a slight chance that someone in their camp are watching this thread, he may not want to announce his surveillance moves but I would also suggest protecting the game camera by mounting out a house window if an angle of the area allows this.
My $.02

This is an excerpt from Wikipedia's definition of probation. "During this testing period, an offender faces the threat of being sent back to prison, if found breaking the rules"

Apparently they need to update their definition as this seems inaccurate with the real world. I am sorry for your struggles Tim. Hang in there, it will work out.

Personally, I'd be glad to have someone know. I'd post signs that the area was under surveillance and take pictures of those signs on the property for any future "court sessions", if needed.

Now I wouldn't post..."I'm going to hide a camera in the big oak to the left of the road" or anything like that.

The system is called the CRIMINAL Justice System not the VICTIM Justice System. The title accurately describes the results.

 Hadn't looked at it like that, Dan. That is what it seems like quite often. We actually had a neighbor go to jail a few years ago for ripping out flowers we had in flower boxes along our front fence (he got about 4 out of the 17 boxes)...he was on probation at the time too...and was caught on video cameras. :D

I think he did 3-4 weeks and was supposed to pay $40-something in restituion, which we never saw but never made a stink about it...the jail time was sufficient.

We never had to go to court or anything, an actual detective came out after our complaint and took care of it all. It didn't hurt that the neighbor was well known to police.

How low can one go to steal someones plants....

Years ago, DOT completed a bypass around our town and at one of the overpasses they did a great job landscaping. One Saturday I was driving out to work on our land, we did not live there at the time, and I noticed a truck on the side of the road at the overpass. I was not really paying attention to the truck but just before I passed the truck I noticed there was a man and woman pulling up the just planted bushes and tossing them into the back of the truck!:shocked::shocked: I did not have a cell phone and I did not get the license number so I could not call in what was happening. I was really annoyed at the theft AND that I could not call it in. You can still see where those plants SHOULD be.:mad::mad:

I figured in a small town I would see that truck again but I never did. Not that I could do anything about it after the fact but I thought I would see that truck...

POS.

Dan
