Purchased new tractor that is rented out?

Maybe I'm wrong but when you pay for an item at that moment
it belongs to you. Example when you pay for a new car/truck
that's on the lot you don't have to wait for a few weeks to get it
its yours as soon as you pay for it you may have to wait until the
next day to pick it up as they have to service it or check it out first.
It should be the same as with a tractor or anything else.

The purchase order should stipulate why the new owner, that has paid for the product, can't take possession immediately. How can they sell an item that someone else has dibs on (the people using it)? What if the OP would call the police and would say he didn't give permission to those people to use his new tractor?

I would demand immediate delivery (and in undamaged condition) or a full refund.

If the purchase/sale document does not stipulate when you take possession, I would think the default is as soon as the paperwork is processed. Certainly, by the time the funds change hands.

Can go back and forth, but the real way to solve this is to call your dealer and ask them what is going on, tell them you expect the tractor by the end of the week and that it be clean, newly serviced and in good working order.

If they can't do that, then its time to negotiate further discounts/ free service or get a refund. Coming in hot and angry ain't gonna help, I've tried that approach in the past and it just pisses people off and slows things down. Be reasonable, but firm in your request and stick to your guns if they try to sweet talk you.

I wouldn't buy it. What if, now that you own it, something happens to it? Who's responsible? The renter, you, dealer, warranty? You may own a damaged tractor with no one responsible but you. For myself, there wouldn't be enough money off to purchase it.

I would start at the dealer. Be polite, but very firm. You expect your tractor to be delivered immediately. No nonsense. If they push back on that, tell them your next stop will be the DA's office, or possibly the police/sheriff's office.

The rental company is making money off of equipment that does not belong to them.

Put a stop on the check immediately, that will get their attention real quick.
If that doesn't work, visit the D A office today, I have never heard of such a thing as this!
