You might try one of the motion activated water sprinklers. Critters get within a certain distance, they get a good spray of water. Here's one from Havart.
Milorganite. It's a fertilizer product sold at the big box stores. Made from the treated solid sewage at treatment plants of Milwaukee Co, Wisconsin. I know, doesn't sound appealing, but the stuff is highly refined and there are no pathogens that survive the high temp production process. It's an awesome fertilizer, and the deer won't go near it. We started using it last year. We've got it on trees and bushes that the deer have mutilated in he past, and they now won't eat anything where the Milorganite is spread on the ground. My wife has a loquat tree, transplanted from my mother's place in Florida, and the deer had eaten it to a nub every year, five years running. Last year, we started putting the Milorganite on it, and it's thriving, unmolested by the deer. The grass near wherever we put this stuff also grows really fast, lush and green.
I now recall reading a report on this. If memory serves, with little rain, deer will avoid areas where Milorganite was applied for up to 30 days.Milorganite. I'll whip up something...probably a combo...if I still have any tomatoes left this morning.

Sorry, couldn't help myself. I have never used any. To date the deer only eat maple saplings. The even stay away from our flower beds and garden. They walk right through the yard but don't touch a thing. knock on wood.
