Sharing a Pond Questions

   / Sharing a Pond Questions #51
MossRoad, I have to agree (I won't go through my earlier post again) that in Indiana a body of water is shared by all who have property that goes into that body of water's natural water line. Another issue I had when I lived there proved differently. As I'd mentioned, I'd lived in a neighborhood where most houses were on small parcels of land. I owned a much larger, but yet still modest, three acres of property plus another two and a half acres of the lake I was on.

Can you believe that I even had to seek legal council and the law to prevent others from walking their dogs onto my property to do their, er...well, duty!? The neighbor's contention was that their property was too small to have their dog poop there because their childred would surely walk in it and track it into their house. Since I had by far the biggest yard, it was only right for me to allow all the other homeowners walk their dogs in my yard to poop. That sounds absoultely crazy, but that too was something that I had to put up with and spend money to prove wrong and prevent.

I agree with Henro to try to be "neighborly", but some people will never fit that catagory. Plain and simple, there are a lot of people who think property ownership works like the government; take away from those who work for it and give it to those who stick their hands out. It still befuddles me as to why I had several neighbors before who thought that I should have to allow their dogs to poop in my yard because theirs was too small. When I suggested getting rid of their dog or just picking up their own dog's poop in their own yard, they went ballistic! Fortunately the law even in Indiana does not provide for you to be able to take your dog to your neighbor's yard to poop, even if you have a small yard! I have no close neighbors now, and those who do border me are the good country neighbors that you'd want. My acre and a half pond is completely on my property and I have no neighbors who feel that they should have free reign of it. Whew!
