Alan, under the circumstances you have described, you had NO CHOICE but to handle it as you did. It's unfortunate that the destruction happened, but to be honest, you had no idea who and what you were dealing with. Those kids could have been relatives of the owners. Sounds to me like you folks that own property up there need to have a meeting to set down some guidelines as to what you will and can do to help one another from now on.

About 3-4 years ago, a similar situation happened right around us here, on 80 acres owned by people that lived quite a distance away. There was no drought that year and a group of older teen kids, maybe 10-12 took up partying in the middle of that 80 acres, several nights in a row. They were very loud, had a large bonfire, and it quickly got out of hand, in many ways. We figured it was the grandkids of the owners who have also come dove hunting out here on that property in the fall. We let it slide the first night, but the second night it got louder and wilder and with that huge bonfire on the third night, some of us stopped caring IMMEDIATELY who they were. Phone calls were made quickly to other neighbors, (since the Sheriff wouldn't do anything because of it being private property) and several of us went over in our vehicles. No sooner did our convoy headlights hit those kids in the middle of that 80 acres, than they scrambled to put their clothes back on, and got into their vehicles. They spun out, did wheelies, and tried to go out the only entrance/ exit to the property that we had just come in. We let them go out behind us, and the sight of them speeding down the county road, away from us, was the last time we ever saw them again. No face to face confrontations, no violence, and we put out the bonfire immediately too.

Later I ran into the ranch foreman of the ranch that owns that 80 acres and he knew nothing about the kids or anything. I explained what happened and why the Sheriff wouldn't enter private property. He immediately went down to the Sheriff's office and gave them written permission to enter the property anytime they needed, or wanted to, if the neighbors (us) saw anything going on at the property, out of the ordinary.

Sounds like your neighbors need to ALL give that same type of a permission to your county sheriff. You did the right thing under the circumstances you had. Now it's time to change those circumstances for the good of all your neighbors though.

UncleBuck257,

I don't understand the Sheriff not responding. They don't respond because the problem is on private property?:eek:

Almost all of their calls would be to private property. I can't believe that Texas law would prevent law enforcement from going on posted private property. Following that argument, if you see you neighbors house on fire I guess the fire department can't show up. I would have talked to someone else like the Sheriff and see what he had to say. If his answer was the same and this is not a statue, vote 'em out of office.

Will your Sheriff respond to private property if a burglery is in progress? If I lived in Texas I would like to see the statute the prevents law enforcement from responding to calls for service on private property.

Later,
Dan

You did the right thing. No matter what you'd have done differently, I just don't think it would've turned out good. Property can be rebuilt. Dead bodies are rarely brought back to life. Don't feel bad about this. What you did was R-I-G-H-T!!!

Thanks every one, your support makes me feel better.
I asked about the powers of the constible, and was told all he had power to do is serve papers and stuff for selectman. With the camp owners being his enemy,he had no intention of lifting a finger to help me that night, and that leaves a bitter taste in my mouth.I guess i think wrong, even if i had hated the guy,i would have helped my other neighbor[in this case me] even if it was to lend a phone,to call the property owners.I certainly wouldnt have let a person who was trying to help, get in harms way because of being alone,i would have accompanyed him at least to check the other places.
My wife and i talked a long time on this one.She knows i feel terrible about this happening ,after my gut told me something was not right that night.Next time i will be armed with the owners phone number, and will call him on a cell ,and let him decide how to deal with it .For my personal and familys protection ill have my COLT close by now every time.
I checked my place the other night alls fine. The other owner of property was passing by mine,it was almost dark,i was driving a different car than normal. He would have passed right by if i hadnt of yelled to him.I guess he wasnt to concerned who was at my place.I hope this doesnt turn me into one of those folk that just look the other way.
THANKS ALL,
ALAN

Do yourself a favor and check your local laws and local authorities on what you can and can't do if you are carrying a firearm, particulalry if you go onto someone elses property. If you can, get something in writing.

As mentioned, I do carry, don't take this cautionary (sp?) advice as being anti gun.

If by chance you go onto someone elses property to "investigate" while you are armed, and for some reason you need to use your firearm, chances are you will be in a court of law. Probably will not be fun on your part, even though you were only trying to help. Courts can be "funny" and I would hate to have to "dea"l with them. Heck, even on your own property using a firearm in self defense will get you in court.

State laws varry, not sure of Maines now, but check. The reason why I mentioned to get something in writing is because sometimes the "local law" does not even know what the laws are. CYA!

I agree,

Even out here in the wild west the gun laws are getting much more restrictive. At this point I don't even have a gun in the car anymore. I used to be there was always a gun under the seat.

Now if you are pulled over for a traffic violation and they find a gun or large knife in your car you are done for concealed wheapons charges.

Drive from state to state with a carry permit and it may not satisfy the laws of the new state. etc.

Just to hard.

If that is wrong thinking, then I hope you keep it up. We need more people in the world who will consider the other person. It is just much harder when they aren't nice people. You must be a pretty special guy to spend this much thought on helping out such a neighbor. Perhaps someday they will come to appreciate how good you are to them.

HI
I have a concealed weapons permit, and have had one for years,so with a few excepts [school, bar room, cant remember the other]I am legal to carry. My weapon would be for self defense only.I was taught you never pull [or show for that matter]or point one unless you are gonna use it,and i stick to that.I would not go into a situation like that without a person with me,for a witness if things go sour.I would never use a gun to detain someone, but having betsey with me would give me a little better feeling in going into a 4 on 2 situation. with drugged or drunken people.Having said this if they pulled one on me,they better be good ,because i am that good with mine, they wouldnt be around to sue me,they wouldnt be wounded.
Dont get me wrong guys i aint no dirty harry, but i believe in the right to bear arms.If more people carryed there wouldnt be so much crime.Just my opinion, and i consider others.Whats the world coming to when you cant defend your self?
When the police were called that monday morning it was 4 or 5 hours before any arrived. They were told the individuals could still be on property somewhere. The land owner and i searched our selfs. He would leave me at an intersection,to check out a road [so they couldnt slip by]All i could do is throw a rock at them if they tryed to run me down...now thats a scary feelin...never again.
