Now I get a call from the dealer that kioti wants them to pick the tractor up so go I'm think what kioti and me talked about . NO !!!!!!!!

They want them to pick it you to find the problem and fix guess what I'm not letting them take it. I am going to listen to the lawyers you have prof for the year and some odd months they tried fixing this issue and have not as for the lawyer and the AG office with our law they would have to give back my money or give me a new tractor the lawyers said at this point not to give them the tractor go over as they say getting ride of evidence.

I'm really sorry so many people around you are getting your hopes so high. CM and I are absolutely right on this one, the chances of getting a new tractor are virtually non existent. Even if you do fall under a lemon law, you're still on the hook for the 1+ yrs you've owned it.

Let them take the tractor. But first, negotiate with Kioti that the dealer will bring you a loaner. Instruct them to keep your tractor as long as they like and test it until they know it is 100%. Then make sure that everybody is under the same understanding of what happens if the problem re-occurs. Push them for that answer now, will they buy it back, buy back on a trade etc...

Do as you like, but unless you're willing and able to spend a LOT of money fighting, a fight that you're not guaranteed to win, let Kioti get involved and follow the process a little longer, just start to take charge of what happens next.

Do you have a means to record video?

Document how the tractor is behaving in video, then give it to Kioti. That is likely the best chance you have for a resolution.

Do you have any proof that an outright exchange was offered? Or was something misinterpreted on your end? Any emails / letters / fax indicating as such?

If the dealer is a different and reputable one I am not seeing the issue with them taking the tractor, unless you would rather have a lawsuit than a repaired tractor. As in the case if the military truck, it is probably something simple to fix given a good mechanic. There can't be a fundamental design flaw, Kioti has too many happy owners for that to be the case. Maybe you could ask for the new dealer's paperwork direction from Kioti if that helps you settle your mind.

The loaner idea above is great one.

How long has the tractor been doing this? How much warranty do you have left? Tell them you don't trust the tractor with all the problems you have had. You should make a video like Jason suggested. You need to document everything, what was said when you talked to them and the date and time, when the tractor is in for repair document what was done to it and document the days they had it.

So talked with kioti they talked about exchange it . Not share . My wife's boss is a lawyer and said if it is a even trade with a new one then yes you shouldn't have to pay anymore you gave them a year and some odd months to get it right. By law you gave them a lot of chances. As he is friends with AG here in Maine. Or as he said you could get what you own on loan back not the hole amount as there is ours hrs on it. We will see right now my brain has enough on its mine with how am I going to help a family heat and how I can get my health issues fixed need back surgery but can't be as he said lade up for a yr.

.... you are in a real dilemma. As I try to understand it, you are working for a non profit group, you and your family have very serious health problems, now you need an operation because your spine is wrecked and at times people in your neighborhood steal things from you.
LaK with all respect here, sometimes in life it's time for a guy to just move on... maybe try to find some other way of living? I don't know you and you really seem like a nice fella... but maybe you should be receiving help in the city, not giving assistance to others out in the country?
No offense intended but my friendly opinion is that you should try to de-stress your life and get out of tractoring and the non profit service-club business altogether.
Let Kioti take the machine and when you get it back just sell it. Hopefully your thieving, hillbilly neighbors won't steal it on you or sabotage it when you get it back.

Tractor fixed or lawsuit, results unknown, and you could still loose in court. You bought in NJ, moved to Maine. Lawsuit could be hampered by how far from home you bought the tractor, whether it was bought for non-personal use, (not- for -profit) is NOT personal use, and how you paid, where your loan is based, jurisdictional issues, etc.
There are NO guarantees in suing Kioti, and as long as they are still willing to take it back and work on it you don't really have a beef with them for trying to resolve it. You should be dealing with the zone manager, not the dealer directly. This is how issues like this get resolved. It is the chain of command for all dealers, cars, trucks, and tractors.
You've come this far- why stop now? They are NOT going to GIVE you a new tractor; and if they do I'll be the first to say I was wrong!
Give it to them- it's not doing you any good anyway.

I'm no lawyer, but I think your lawyer is either giving you bad advice, or you misunderstood, when he told you not to let the dealer pick it up so they can't "hide the evidence".

The "evidence" is that your tractor doesn't work. If they pick up the tractor and bring it back to you, with the "evidence" missing, it sounds like a victory to me.

As frustrating as this all is, it is most likely repairable. Like the anecdote on here about the military truck with no-fuel symptoms, the dealer may find this gremlin and kill it. And, with Kioti's attention on it this time, the dealer's mechanic may get some top-notch troubleshooting support, find the $1.99 part that has been causing you so much grief. There is no way this tractor happened to be built with one-each defective part from every bin in the parts crib at Daedong. It is one part, two at the most, that are causing this, and they just need to find it.

If they do get it fixed, be sure to make them give you a list of EXACTLY what they did and post it here (maybe have someone type it for you so we can understand). The fix for this problem may be a very valuable bit of information for someone else on this board down the road.

Agreed.. Its part of the process anyways. Let them have it WITH a loaner and agreement.
