Unfortunately, I think this is why these people start these law suits. They are reasonably sure that the insurance will settle out of court for some lesser amount. FWJ gets falsely accused of causing a problem, and unless the insurance company feels they have an air tight case, they settle to avoid a higher judgement. I don't know all the facts in this case, but this is what happens a lot. Sorry to hear about it FWJ. Leaves a rotten taste in your mouth.
I would think though that compaction would be hard to pin on you, having only mowed the area once.

That guy is a frigg'n jerk, I WOULD agree with WARRENF, but seems only the lawyers come out in those type bogus, frivolous deals. There has been deals like that around here where a drain field got ran over and smashed, dug up personally burried phone/power lines and such. I was advised to have a disclaimer on my work order to guard me against frivolous stuff. I have done just what FWJ did, friend of a friend, person seems decent, extra job, no big deal. But have not had nothing like what happened to FWJ. Takes all sorts to make this world go 'round. Some we do not need, but we got'em anyway. Seems open/closed FWJ, Hope it all gets straighten out and all the costs fall on the jerk.

you mentioned that this guy is a friend of a friend and he referred you to him to begin with? are you the least bit curious as to if your 'friend' knew how this guy was to begin with, or at the least, that he was having major problems with his septic tank before you came along? if so, then this 'friend' of yours doesn't sound like much of a friend to me. just out of curiosity, who's side is he on, yours or the other guy? are you counter suing for non payment? hope this works out for you, that's a shame to hear that.

Friend works with the guys neighbor. He just passed along my name and number. He knew nothing of this guys situation, nor of his character. He feels bad about what happened, but it's definately NOT his fault.

Some progress on day one.....My attorney had a phone conversation with the complaintants attorney. Without divulging ALL we know, it's now clear to both sides we know the previous history of septic problems. My attorney said the conversation ended with them agreeing this wouldn't make it far in front of a judge. I'm told to expect the suit to just "go away". Part of me wants my pound of flesh, but better judgement says to be smart and not stoop to his level. I'll keep you all posted.

Maybe your attny can let his attny know you are strongly considering fraud charges. Then let him worry about that for the next several months even if you have no intention of doing anything.
