He is in jail, on $75,000 bond. He has had the bond hearing, and a prelim hearing, both of which I attended. In the prelim hearing his lawer asked for a reduction in bail (I assume it was so he could get out to steal enough to be able to pay the lawyer) and it was denied. He is still in jail awaiting his trial. And I am also (not in jail, but awaiting the trial). Plan on being there, but if by some unforeseen reason (just about death only) I want to make sure he gets his just deserts.

I am glad you handled it with care which is probably more than I would. I would have probably been at the police station explaining how an unarmed person can be such a threat as to require the level of defense that I opted for. My stuff may not be much, but it is my stuff and if anyone wants it, they should be prepared to fight for it, and I don't fight fair, as I have to assume that they don't also.
A weedeater wouldn't be worth somebodies life, but they must not have thought so to come onto someone else's property and take that risk.

The chances of a bullet going thru a tire casing and still containing a fingerprint is almost non existant. However, from close range as this might have been, the casing itself might have been ejected if it were shot from a semi autoloader. That could have a print on it, or at least the ballistic's print of the firing pin, which would be of help should the culprits be caught. However, due to the large number of .22 bullets being fired from a large, very large number of guns, finding it will require the culprit to be caught, and the casing be used to convict him.
.22 bullets are shot from a massive number of guns that aren't even built to shoot .22 caliber bullets, such as the mini-14 I have with a .22 conversion kit installed in it. There are also conversion kits for .45 caliber pistols, M-16 and several others. A needle in a haystack would be easier to find that tracking the gun by that bullet, but having the bullet and shell casing would be the way to convict him if caught.

Let's see O.J.accused of murder walked got off scott free, Robert Blake accused of murder walked, Phil Spector's accused of murder walked, is walking the streets, Nicole Richie spent 83 minutes in jail for driving the wrong way on a freeway drunk.....I can't wait to see how they come down on this guy.

If they slap his hands, you know that will be considered cruel and inhumane treatment, so I'm thinking they will just wave their finger in his face and say , NO! No! No!

Have a good dog (Black Lab), and she runs loose outside, think she may have licked his hand, she loves everybody. Also, have a 12 gauge, and a 30-06, 20guage, another 12 guage, a 22 rifle, and a 32 hand gun. All were (are) unloaded. But after he left the first time the officers asked if I had a gun? Told him yes. He said I should have stepped outside and fired into the air to scare him off. Told the officer if I had stepped outside I wouldn't have shot in the air. He told me I could be prosecuted if I shot him and he wasn't breaking into my home. I told him he would have been by the time they got here, and they would have asked me why I shot him 9 times, and I would tell them because I hadn't reloaded yet.

I loaded the 32 and had it in hand when he came back the second time. Had stepped out the front door and was sitting on the steps trying to figure out what to do when an officer walked around the side of the barn. He went to the side of the house and when he got out of sight, I stepped back in and put the gun down. Didn't think it would be a good idea to be out in shorts with no shoes or shirt, and a gun in my hand.

Hadn't had a loaded gun in the house in 25 years. But it is now, and will be for the future.

It sure isn't a bullit, but I've got a neighbor kid who's smacking golf balls at my barn. The culprit and his parents live on a road that runs along side of my place. Unless this kid can out drive Tiger Woods, the balls hitting my barn are being hit from my property. He's made himself visable before and after several of the incidents, carrying a golf club as he walks down the road. The police, while attemping to be cooperative, have laid out what we're dealing with. They either need to see it happen, have an independant witness see it, or I can capture it on video. Otherwise, it's my word against Jr.'s If we do catch him red handed, he's 15. Slap on the wrist, send him home to mommy, and essentially do nothing. Ever deal with a punk teenager who you've just had arrested? Quite possible he takes his actions to the next level. Mommy and daddy both work quite a bit apparently. I can't seem to catch either at home. As good a chance as not, I confront them and THEY become irate. Ever accuse someones "angel" of being a delinquent?

SOMETIMES, the best course of action is to do absolutely nothing. Kid gets bored and goes off to pester someone else. To assume confronting the "wrong-do-er" will make things right can put you right in the crosshairs sometimes. Proceed with caution.

That's how these kids get worse. No one wants to make them mad or feel bad, so we don't do anthing. This makes the next step easier. I'm a firm believer that if you do wrong and get caught, there must be a punishment. The size of the punishment is determined by the severity of the deed. No ifs, and or buts. I realize that hitting golf balls against a barn side may not be murder or robbery, but if it's not your property, then it's wrong. And even if it was without thinking it was wrong, once confronted with it, then it becomes with malicious intent and should be dealt with.

I agree to an extent, but the future of SOMEONE ELSES kid isn't MY responsability. I personally couldn't care any less if I "make him mad, or feel bad". That's not my issue. I agree with the concept of "get caught/get punished. However, I also believe in the realities of life. If this kid gets caught, he won't be punished in all likelyhood. I can't punish him. The parents, given the way people are these day, won't be apt to punish him. The police aren't able to punish him, nor is that actually their job. The courts won't take action until there's a pattern of delinquency. In the end, I have to do what's best FOR ME. And that MAY be to let things just "go away" if they will. If there's a continuation of golf balls slamming into my barn, I'll take it to the next level. Problem goes away? I have bigger fights than trying to tame a neighbors out-of-control kid. I'll fight the battles I can win.

So how do you get the video evidence? Time delay, heat or infared activation? Or just sit out in the barn waiting on the kid to come up with enough balls to start hitting some of them your way? I am pretty sure the parents would have to change their mind should you come up with evidence and are heading towards the police station with it. However, you are right in having to deal with the fallout, which is easier said than done. I am a stubborn cuss and would just have to deal with it, because anyone damaging my property would be headed for a run in with me. One of my many faults, no doubt!
