I think 'as is' may not absolve someone in all cases. People expect 'as is' to mean there is or could be some problems, sure. But I think it would be more sensible to state 'ROPS safety equipment removed' in this case. Why beat around the bush with 'as is'?; spit it out. Declare the exact known defect(s) and get a signature saying the buyer is aware of that.

Everyone knows a car has brakes, not everyone knows what a ROP is or its purpose.

I would keep the ROPS even though mine is probably rusted into the folded down position. :D

As this country has seen this year, a good prosecutor can convince a jury of just about anything. I think it should be equally as obvious that buying used equipment doesn't have any of the guarantees that a new one has. The seller should have a moral obligation to point out any known defects and if he doesn't, well, maybe he could arrange to be heard by judge judy.

Sure how much liability insurance do you carry and how many assets do you own/have?

Keep it in the barn, I am sure it is not taking up that much room.

How would feel knowing the person you sold the tractor to died or worse has no feeling below his waist because you made $200 selling it.

It's his tractor. Do what he likes. Personally I would keep it and reinstall if I sold it. As I think it would be an asset for the next buyer.

BUT if a new owner rolls the tractor over because they are a poor operator... It's not the previous owners fault! We in the USA are quickly loosing self responsibility. Its always someone else's fault right?! )0:

I agree that it's not the previous owner's fault. However, that doesn't mean the previous owner won't be sued. It may inconvenience him and cost him a significant amount of money regardless of whether or not we agree that he isn't culpable. The used ROPS isn't worth much, so why not just toss it in the rafters and reattach it when he sells (assuming he insists on having it removed, which I don't think is wise). It's very cheap insurance against that lawsuit, no matter how unlikely it might seem.

One time I was fabricating some project in my shop. I took a bunch of pics and posted a thread on TBN. In the background, on one of the pics, was the ROPS for my JD2210 hanging on the wall. That generated 2 pages of as Papaperk would say "good ole fearmongering" before we got back to the subject at hand. I love these discussions. Rarely surprised at where they end up. And for the ole timers of TBN, it's usually predictable where they stand. :D

I agree.

But I do find it ridiculous our country is so lawsuit happy.

I'm saying go ahead and hang it up. But it's basically worthless to sell used and will likely cost him money not to have it on the tractor when he sells, so I'd recommend holding onto it. I think it's funny that some people are so anti-ROPS that they want him to scrap it on principle...
