I recieved one of the letters from NH and called my dealer. He told me everyone who bought a Boomer received the same letter whether their tractor was effected or not. Is this true? My property is very hilly and I'm concerned that my dealer is not too concerned.

Flint, I think your dealer is blowing some smoke your way. I bought my TC45D in early February and when I didn't get a letter, I asked my dealer specifically about the recall. He showed me a list on a piece of 8-1/2 by 11 paper with 3 numbers hilighted on it. He said those three were the tractors he had sold which were in the recall and my serial number was not amongst them. That's why I did not get any notification.
I would suggest that NH has been very up-front about this problem with the people it concerned. Maybe your dealer figures if he can get everyone to come by and check, he can sell them something while they are at his dealership. Actually, it just doesn't make business sense to me that someone would write letters to everyone when only a few would do. Of course, if your letter said, "There is a recall, but you are not included...." that would be considered a good dealer who wants you to enjoy your tractor and not worry.
Just my thoughts on the issue...

If you got a letter from NH indicating they want you to participate in this camaign, it is a pretty safe bet that you have an affected unit. If your dealership is skirting the issue, you can contact another dealership or NH directly. Any dealership that sold an affected tractor should have a copy of the list of affected units. I have seen the list of the 1536 recalled tractors so I know it exists & I also know that each dealership that sold any of those units should have that list. In other words you should be able to call any dealership & they should be able to tell you for sure if you're on the list. I would get a second opinion if I were you. Good luck!

Thanks to those who replied. I will contact NH and another dealer. Part of this may be that I had to wait about 3 months to take delivery of my 40D. My dealer told me at the time (Sept. - Nov. 2000) that the delay was due to HST problems the factory id'ed and that they were running my unit back through to take care of the problem before shipping it. He offered to get me another unit from another dealer and eliminate the wait, but said that it would probably then need to be recalled for the same problem. I said I would rather wait and get a good unit. I wonder if now he is covering for some mistake on his part. I'm sure most anyone would appreciate the honest truth and not have their life or health put in danger. As I mentioned in my previous post, my property is very hilly and this problem scares me!
One last question: should any dealer be happy and/or required to deal with this recall and get my business or might some prefer to say the guy I bought it from must take care of it?

Most dealers who did not sell the machine prefer not to do the warranty work when bought at a local competitor. If the dealer is slow then he might but if his shop is very busy then the open slots will go to the customer who has purchased from that dealership. Be prepared to stand in line. The dealer is also paid by New Holland on a flat rate basis which is usually an unrealistic figure. Thus the dealer may loose money by performing the repair to your tractor which he did not make any money at the trime of sale since he did not sell it to you.

This problem has happened again with Dynasim's 2000 model tractor. That means some early tractors with the problem are still out there. I bought my tractor in Feb 2001 and it was not on this recall.
Some folks buying older Class III HST machines might need to be careful because this problem is the tractor jumping out of gear when going downhill, a potentially very hazardous condition.

I must admit that it was a scary moment, when I was going down a bank, and the tractor popped out of gear. Yikes. (I was heading for a cliff!)
I will get this checked out, and report back, but it will likely be a couple of weeks.
If anyone buys a pre-2001 tractor, I would specifically check to ensure that this recall was executed.
