In this mornings mail I got a letter from the town advising me that they are starting condemnation proceedings to take my property by eminent domain. I just can't believe this is happening at a time in my life when I am just starting to feel comfortable in this place....... Seems that some developer wants it for a neighborhood improvement project...... /forums/images/graemlins/frown.gif Being that I live in CT, I don't know how much I will be able to fight this now that the U.S. Supreme Court has ruled..... /forums/images/graemlins/mad.gif

There is probably a lot of truth in that statement until it happens to you personally. Know how I would feel if they wanted my property.

Do not wait. Immediately get a good condemnation attorney and then get a good comdemnation appraiser. Be friendly (you catch more flies with sugar than with viniger) in your dealings with them. You will want to tell them where to go and what they can do but remember, they will get your property, therefore, be ready to negotiate for "Fair Market Value" as estimated by "your" appraiser. Also, you need to negotiate for a "relocation payment" that will possibly cover the higher cost of a new mortgage and very possibly the higher cost to acquire a similar house and property to replace what they take and the cost of moving (movers that pack, move and un-pack and place items for you). Again, they will get the property in the end, you can't fight and beat them so you want to fight for the very best outcome in $'s in your pocket. I spent 33 years doing comdemnation appraising in Virginia and in Florida and I know that comdemnation laws vary from state to state but they are all generally similar. Good Luck.
