The city wants a 30' of easement on the east side of my property for a road. (like I want more people driving by??) I think thats too much. I guess I'll have to take what ever "market value" is at the time they decide to do it. I don't think you'd come out ahead getting nasty about it, as they can get nasty back, and you do need their services.

This is highly unusual for a government to take such stringent step. The letters of the law associated with the new Supreme Court ruling haven't been written for general application by any state yet.

In particular, if live in a rural area, it is very unlikely the government can match the "good of all" spirit that the Supreme Court issued.

I believe, unless you live in the middle of a highly developed city, that you have a strong case for keeping your land.

I would consult with a good attorney immediately. They sound like they are being frivolous. There are also many, many members of the media that would be interested in your case.

I have a friend of mine that works for FOX news – I told him about your story and really wants to speak with you immediately. In fact he has a couple of people in your area waiting to find out where you live.

Junkman I really don't think they can take a cemetery by eminent domain. You do have a couple of dogs buried on your property don't you?
