I have not researched it thoroughly but I would be surprised if ALL diesel meets the new ULSD specs. Today, any fuel that does not meet the 500 ppm spec can have red dye added to it and then be sold as off-road. Will there be no similar provision for fuel that is 16 ppm when ULSD hits?

Take a look at this thread. It gives a summary of the new regulations and a few links to additional information. In a nutshell, ULSD will be all you will be able to purchase. There will be some areas where LSD can still be purchased but these will be few and far between due to the fact that only smal botique-like refineries will be the only ones authorized to produce LSD. California will only have ULSD, nothing else.

This conflicts with what I was told on another thread in this forum.
There it was stated it was illegal to have red fuel in an on road vehicle even if it wasn't on the road .

I'm confused as to just which one of the following acts is illegal .
A* Having red diesel in an on road vehicle .
or
B* Using Dyed diesel on the road.

Situation A is stickier. I would think it would depend upon the location of the vehicle, i.e., whether it is on the owner's personal property or not. But again, the fact that it is an on-road vehicle opens up the possibility that it could be operated on the road with the red fuel in it.

If I am the judge in this case, and the truck is on the owner's land, I'm going to want to know why said truck has a license plate if it is only going to be used off-road. There would have to be a really plausible explanation or I am going to rule "illegal" in situation A as well.

In the situation of a truck with red fuel in it but not at the moment being driven and also not on the owner's property (such in a public parking lot, or private property that does not belong to the owner), it would seem obvious to me that if the truck could only have arrived at that location by using public roads...that seems obvious: Illegal.
