Sounds like two jerks have met. When the complaint is small the problem you have in resolving it will be large. This never made sense to me before I had given it some thought. Even if somebody does something now it will forever be a sore spot. The dealer should be dancing because It was He who put the hours on it after it was sold. 5000 hrs later no one but these two will care.

Big difference than 12 hours around the lot.
Also how does it count hours?
There's been discussion on smaller tractors that an hour of human clock time does not equate to an hour of tractor clock time if the tractor is not being run at PTO speed.

It could have idled for a day and not run up 4 hours.
Reads like he needs a different dealer anyways. The problem is that his down payment sounds like an expensive lesson.

I don't understand why he doesn't get the downpayment back. A downpayment could be substantial. If he agreed on a deal with a tractor that has 2 hours on it, it seems he'd have the right to refuse the tractor if the hours are different.
I probably would have done the same thing. The hours are one thing, but the bucket being all scratched up is another. Yeah, I know the bucket is going to get scratched in time anyway, but it's a new tractor.

Sounds like the dealer has some explaining to do. What does a tractor that size rent for? 10 hours at that rate might be a place to start.

I bought my 3120 as a demo unit. I don't remember the exact figure, but it was actually closer to 25 or 30 hours. It came with all the benefits of new, except around 23 less hours, full warranty, etc. I knew I was getting a demo and got a substantial amount off the list price though. The difference here is he didn't know. I would return the machine and go to the dealership right down the road and get the same machine from a different dealer. Unless he is willing to correct the situation, he doesn't deserve the money. Though the 12 hours is not a big deal at all, the fact the dealer didn't tell him about it is - just what problems with warranty and other services will he have down the road with this dealer?

I think Martian is right, and the since the dealer is causing problems now, what is he gonna do when, god forbid, there is warranty work? I've never bought any big purchase new, so I don't know, but isn't there a regional rep. that he could call or send an email to? If I made a deal for a tractor with two hours on it, I wouldn't fuss if it came with four, I would account it for the dealer washing it and doing finishing touches for delivery, but 12 hours and a scratched bucket on a sold tractor is a little fishy. Is it possible the wrong tractor was dropped off?
