People often sue hoping for a settlement, "hard to win" just won't do it for me. I have seen people spend a LOT of money defending a lawsuit. Maybe you can recover attorney fees and maybe you can't.

Hopefully, the property is covered by some form of liability insurance. The insurance company will defend the suit, if any. Unfortunately, they sometimes hand out go-away money to save attorney's fees. They get it back in the end with increased insurance rates, if not for the named insured specifically, then a little bit from everyone over time. The property owners always lose in the long run.

I did quite a bit of reading before we bought land and found quite a bit of interesting information on the NC Extension website. One page that I read and I follow to this day is to post the land. Posting makes it a criminal offense to be on our land which minimizes our liability. Notice I set minimizes. We also carry a policy for a variety of events. Years ago on TBN we had a member named who mentioned two lawsuits against landowners. One was a guy was riding a horse through the woods. The horse stumbled in a stump hole or some such and the rider sued the land owner. The other case was when a brother and sister by a friend of the sister to ride horses. The sister got on a horse and the brother thought it would be funny to slap the horses rear. The horse reared up and the sister got hurt. The landowner got sued.

Frankly, letting anyone but close family use your land is risky. I post the land, keep it posted and I have run off some poachers and trespassers. By definition, they are breaking the law, and I don't want them near me or mine. That ain't be old. That is just being wise.

I do have posted signs up at all road and trail enterance's. I had to deal with guys asking to hunt my place the first year, i got all kinds of stories from them. only one guy was a little bit of a jerk. I was told if someone really wants to sue you they will (with a reason) , its IF they can win he suit thats more important. Also by putting up signs you are admitting there is a issue like a "beware dog" this shows that you te dog owner knows there is or ha been an isse wit our dog. Our court system is just messed up, another issue i know.

I'm about ready to post my land. Like TripleR and others, I have tried to maintain Maine's tradition of open land access for recreation and hunting. But most people are clueless about how seriously many land owners take their land.

I have always told people they are welcome to pass through on a trail that existed long before we bought the property. The trail is marked and I have signs saying "please stay on marked trail". But - there is always some idiot on an ATV that can't resist wandering around on my other trails where I would like the wildlife left undisturbed.

The last case was somebody riding through a trail section I worked on this summer. I got it to the point where I will let it settle over winter, so I seeded it with conservation mix. The bare ground and fresh grass sprigs are impossible not to notice, but they rode through it. No real damage done, it's the uncaring stupidity of it that is insulting.

I'm too old to become the "trail warden" on my own land, and the deer hunters are just as bad. They don't ask or say thanks. It's a shame but there you have it.

Your policy of allowing unfettered access to ATV's, Campers, neighbors or strangers will not turn out well...I don't know when but at some point you will truly regret your generosity.

I got burned even giving permission to a "local" guy who asked to camp and fish at my swimming hole with his 13 yr old son. First time they camped it was just him & the boy...one tent. A few weeks later he returned and the pick up's started rolling in. 15-20 people hooting hollering all weekend. The clean up was massive....they left behind broken beer bottles IN THE CREEK, dirty diapers, cans and glass in the fire pit....3 garbage bags full.

I got burned even giving permission to a "local" guy who asked to camp and fish at my swimming hole with his 13 yr old son. First time they camped it was just him & the boy...one tent. A few weeks later he returned and the pick up's started rolling in. 15-20 people hooting hollering all weekend. The clean up was massive....they left behind broken beer bottles IN THE CREEK, dirty diapers, cans and glass in the fire pit....3 garbage bags full.

Exact same thing happened to my father in law, one guy had permission and when I drove up to the lake, it was covered up in cars, people and boats. We didn't wait for the mess to accumulate, we had them pack up and leave.

There are exceptions though. We knew a wealthy, self made businessman who owned his own farms and lakes, but liked to come down and fish on our secluded lake so no one could find him. He fished by himself until he got to the point he needed help with his boat then occasionally brought his son. He didn't keep any fish unless we wanted some then he would clean them for us.

He brought equipment down and made a boat ramp and put in a culvert on the access road; was always asking if we needed anything done and brought us a LOT of processed venison the year before he died. He was truly a gentleman you didn't mind sharing property with, but sadly he was the exception rather than the rule, now no one is allowed.

A guy near us had/used to have Long Horn Cattle! :shocked: Them things were HUGE. Then there were the horns! :laughing::laughing::laughing: He just liked the look of them so he bought them. They sure were big and mean looking! :laughing: How he bought Long Horn in NC is beyond me. :D

I had the same experience with our lake years ago....what a mess and the father , son and wife turned into 20 + people who left a horrible mess....We never allowed anyone again except our own family.

I disagree. It can (will) cost you a fortune to defend yourself. Possible bankrupcy. And this over something caused by THEIR stupidity!
