Good point, but not a perfect analogy given that music and movie distribution are mostly controlled by their respective cartels (RIAA and MPAA.) There is no such tractor cartel, and as such, real competition prevents vendor lock-in. But let's have some fun and pretend such a tractor cartel did exist...

Assume all tractor and implement distribution, for all brands, is controlled by the TIAA (Tractor Industry Association of America). The TIAA mandates what tractors and implements you can use, and how you can use them. Implements are licensed per tractor, and tractors are licensed per user.

Should you sell your existing tractor and buy a new one, you need to buy all new implements, since they are licensed for an individual tractor. For the same reason, you can't sell your old implements.

Likewise, your son/daughter/spouse/neighbor can't use your tractor or implement, as you have a single user license. Maybe you can can purchase the multi-user option for an additional fee.

Should you violate your EUTA (End User Tractor Agreement), the TIAA revokes your license to use your tractor and implements, and Vinnie arrives with a flatbed truck to pick everything up. Unfortunately, your $30K+ tractor and implement license fee is non-refundable or transferable.

To enforce all of this, TIAA tractors have an iris scanner with a wireless connection back to TIAA managed servers. Should the operator eye scan not match up with the TIAA database records, the PCM controlling all tractor functions is disabled.

Likewise, DRM is employed to prevent hooking up an unauthorized implement to your tractor - the PCM also controls engagement of your PTO and hydraulics, and if the unique ID of the implement isn't associated with the unique ID of your tractor, it can't be engaged.

Umm.. you license your tractor for farm use and pulling a plow. Thats the use the tractor manufacturer intended it for. You choose to use your tractor to pull a float in a parade and they send Vinny out to confiscate it again.

I copied this quote from the majority opinion of the Supreme Court directly from the link to which you referred me:

The key, therefore, to the sense of "beamed" is "...invited to witness...free of charge." There is nothing there about Pay-per-view, which is what you described above.

If I were to follow your logic, then I should be able to go back to the movie theater as many times as I want to see a picture if I paid to see it once...As for your e-books, look into audible.com, the leading provider of spoken digital content on the web. There, once you purchase and download a book, you own it forever and amy download it as many times as you wish (Disclosure: I own stock in audible.com).

If you don't want to see the fees associated with the new technology, then don't buy it in the first place. If enough people feel that way, the providers will either change their policy or go out of business. No matter what, entertainment is still market-driven.

Frankly, everything I've read about this subject sounds, at least in some subtle manner, like folks trying to get something for nothing.

Don,

Pay per view is exactly as you are talking about it. DRM will enable all content to become pay-per-view or pay-per-record.

Once HDTV is all there is, all HDTV will contain the anti copy bit if the broadcaster so chooses. So imagine, you pay comcast your monthly fee to get basic cable. Even though you have fair use rights that guarantee you are able to record and do what you wish with that content from comcast, they put a digital anti copy bit in the stream. You legally can't remove the bit (the encryption) from the data stream to actually exercise your right to record that content and view it later. They may choose to sell you the feature to remove the bit so that you can record the programming.

Even using your Pay-per-view example you have fair use rights. You have the right to purchase pay-per-view and while watching it you have the right to record it and watch it again later in your own home. This is what media companies despise.. this is also what they have backdoored on the consumer with the laws regarding encryption.

Now that I see where you are coming from hopefully that example above clarifies it a little better.

Make sure its a printed book, Don't read them an ebook since you'll violate the EULA and Vinny will come confiscate your tractor. heheheheh

Edit: Oh.. and on the serious side of this.... Librarians are probably the biggest group going against all this DRM junk. Libraries are very much at risk if this DRM continues as it is now going.

Look at the software example. You bought it, you should be able to use it and re-load it if it becomes damaged.

We bought better laptops, and we sought out and "negotiated" critical software licensing arrangements JUST to avoid these issues. At one customer site.

I should say, that customer, carries a pretty hefty wallet, money talks, ya know.
