Years ago I hired a lawyer to advise me in a situation that was starting to get sticky. His first advice:

"When I start a case like this, I try to work it out, but I think forward in time to where we've had to go to litigation and I'm making my closing summation. I really hope that I'll be able to say to the jury, 'ladies and gentlemen, in this case my client has always behaved honorably and legally. What about planing a line of trees along your property line? Screening trees? Hedge type trees? Or just ornamental junk trees?

I like this idea.

A person could plant Black Walnut trees. Nature's natural round up....and worth a small fortune when 40-50 years old.

I have heard that, but I have two monster black walnuts that don’t seem to inhibit anything from growing around them, even climbing up them.

As others have mentioned the perp is not a young person but I agree with your statement, particularly in the big cities out here and in the NE. Good new thread idea.

Sometimes you just can't keep them happy. Having bought an 11 acre spread, I was the new guy. Noticed some folks bordering me were "using" part of my land. I had it surveyed. One neighbor agreed to move a small section of his fence a bit. I bought him a Tpost puller. We get along great today. The other neighbor was outside when the surveyor was present. He tried arguing with the surveyor about the line. Surveyor told him to pull a line on it, which he did. Owner says he wouldn't have bought this place if he knew the line was way over here. Surveyor was right but this neighbor was pissed off to no end when he found out my property was actually right next to his driveway and disrupted the mower access to his back yard. I asked neighbor to not build on it or do anything else with it, which he ignored. It's been years now, over 10, and we haven't had a word to each other once. I figured no big deal. Here is a guy who is pissed off because he can't use my property. I noticed he still mows about 3' onto my property. I may just fence it with some goat fencing to keep him off it. As someone said earlier, it is your land, you shouldn't have to justify keeping others off it. It seems to me some people just keep encroaching if you let them and don't defend yourself.

Is there any good reason why you can’t let the guy drive his mower on your property? Sure it wasn’t smart to build a structure that close to the line and even less smart to buy the place without finding the line, but it’s done now. I’m glad most of the people I deal with don’t care if I mow 6” or more likely 6’ on their property.

From what the original poster said, this is 25 feet, not 6 feet.
We have a neighbor who is 6ft over onto our property. We both know where the line is, he mows it, I don't have to mow it, he is a really good neighbor (they are almost like grandparents to our kids) and it gives him much better access to his backyard as well as a place to turn his truck and car around when they park in the driveway. If it were 25ft that he were using, I would probably have a problem as well.

I think it is more that the perp is not civil about driving on and using DB Pilots property. Tears up posts, steals hay, etc. If he asked permission or made some sort of agreement it likely would be different in DB Pilots mind. I agree with DB Pilot and would be looking for a legal way to put a stop to it.

The post I quoted said his neighbor was crossing 3 feet over the line to get into his backyard.
