WVBill, Wire has been left in the grass that I have had to cut out of my 6' brush hog. Just once. But I have found more wire. I do not think sabotage just carelessness. Ruts come and go depending on time of year. Cars and trucks are parked for hours at a time by hired help. Again he has been mowing it in order to get his equipment in easier and herbicides get splashed. In the end I cannot use it. If he would just cut 20' off his 30+ rows of 250'+ rows I think all would be well. He also has space to put more rows and would not loose any product.

First thing is, and I don’t think the OP is even entertaining the idea,but don’t do anything tp damage his crop or equipment. It will only diminish your case against him and escalate a bad situation. I grow grapes, and I can tell you for a fact, if anyone killed any of my vines, I would expect full replacement cost, and 10 years of lost income for each plant, as wine grapes take that long to be suitable for high end wines.

Secondly, a good survey with markers through the area he is using without permission is absolutely needed to give legal standing to your case. If that shakes out in your favor, I would think there are two options.
Have you considered offering him a short term renewable easement? I would be generous to myself here, because if he won’t go for it, his only other option is to tear out enough vines to allow him to turn around on his own property. His vineyard is small to begin with, and that will be painfull for him to do.
Deep ditches and barricades will reinforce the issue.

This is a real interesting situation, can’t help but wonder why you let it go on so long, but better late than never.

Now we have gone from a boundary problem to the neighbor being a nut job in a position of authority that will pull all the survey markers. I think we are jumping to conclusions.

I'm going to offer him the use of my Garmin 12... that should solve the lack of a boundary survey. :rolleyes:

I'm baffled by some of the respondents here. Why would you allow someone to just come on your land and do as they please without repercussion?

I am not advocating just rolling over rather I am trying to suggest some sort of compromise. It is not like his neighbor is trespassing to hunt or fish or anything like that. He merely drives 20-30 feet onto OP痴 property to turn around in the process of his farming operations. Around here everyone does that both ways across a property line. All I was suggesting was OP try to figure out an amicable solution. Since this has been going on seven years it must not be that critical of an issue and it is more of the concept of it that upsets OP than any actual damage the farmer is doing. OP is there anything this guy could concede to you in exchange for you letting him turn around?

How many lineal feet of property line are in play here?

It would gall me to spend good money on nonsense but in hindsight spending money on concrete and pipe could be much cheaper than years of legal...

My farmer Grandfather was wise and simple... the diary farm had been in the family for generations... one of his favorite sayings "When two farmers fight over a cow and get lawyers... the only ones that eat well are the lawyers...

Another thought. Park an old junker of a car along the edge of your property line. Big difference between moving a T post compared to a vehicle. The junkier the better. Then get another, and then another. That alone might get him to rethink his prior actions.
