Why do people always assume somebody is stealing? Violating stupid land use laws is much better. I can show you thread after thread on this site where somebidy is trying to drain or fill a wetland which is no different than this tree rule.
I don't think anyone was assuming he was stealing. I think that by his vagueness and what he was leaving out, people were assuming he was breaking the law. Which he his. Which he is free to do. And pay the consequences if he is caught.
Just as an example, my folks developed a block of land with 17 wooded lots back in the late 50s. In the legal agreement, which was signed by every purchaser of a lot, was a clause that said no trees over X inches in diameter could be cut down without the expressed written permission of my folks. The lots were sold as wooded lots and my folks wanted them to stay as wooded lots. Yet 10-15 years later several people started cutting down trees because they were tired of raking leaves. My folks had to threaten legal action to stop them.
People that purchase property with legal restrictions on it, then whine about the restrictions are irritating. They knew what they were getting into before they purchased, or were negligent in not reading the fine print.
Now, having restrictions thrust upon you after purchase is another story. Zoning law changes, historic districts, etc... that is were grandfathering should come into play. Unfortunately, that is not always done and I empathize with anyone in that situation.
