The survey itself was never disputed. In fact the neighbor just played stupid when the actual property line location was established. In fact I clearly remember the day we were discussing his phone line riser. He built his home a year earlier than mine and he "thought" the property line was "here"....emphasis on the quotation marks

i would go to the land registry office . if he puts some thing there in 7 years he gets it land and all ..go find out

My neighbor used to treat my property like it was his- convenient cut-over etc. I tried markers, posted signs (he took them down), etc- always indirectly.
What worked was when I used fiberglass white posts stuck along my line every 20 feet or so and strung a white electric fence tape along the posts. (not plugged in). It has not been disturbed ever. It runs along my spruce and white pine treeline. (He used to run them down.) It blends in as it weathers.

Thanks. I do some lawn-construction work and am being unwillingly drawn into the landscape thing. I don't really want to pay $1500 for Drafix Pro so something more basic with just treees would work for me.

It is also illegal in Texas. I had a barbed wire fence that bordered my property that was removed by a builder/developer. I took him to court on it and rec'd damages.

I am the neighbor who will cut your grass when the equipment fails, plow the snow off the road and your driveways, check on your kids when the school bus arrives, help you fix your mowers/tractors, etc. A year ago I heard my new neighbor running a brush hog in my woods. When I confronted him he told me that his wife had asked him to clean up the brush along the property line. I discovered that he was also removing trees more than 20 feet into my property encroaching past the old fence line, a piece of which was clearly embedded in a Beech tree. He was clearly aware of the property line when he moved in because I had introduced myself, showed him where I lived, and pointed out the line. Confronted, he now claimed that the realtor told him he owned an additional 10 to 20 feet past the clearly demarked grass/woods boundary. (I later called the realtor and of course they denied ever misrepresenting the property line). I told him to stop cutting and clean up his mess but he continued to cut 28 to 30' into my woods along the 500' + southern property line for about two hours. It was clear to me that he was trying to open access to my woods. His house sits on a 4.5 acre grassy lot and with two boys and a four-wheeler you don't have to be a genius to guess where they planned to ride and hike. I took pictures of the carnage and filled a criminal trespass complaint with the county prosecutor, but they refused to take action. I had to pay $1,200 for a re-survey and install t-bar fence stakes every 25 to 30 feet. My only recourse now is small claims court with a certified forestry appraisal to claim twice the value of the trees that he removed. It's sad that my neighbor didn't have the balls to man up, stop cutting, and apologize for attempting to steal my property and gain access to the woodlot.

I t 's against the law to remove or tamper with a survy pin or monument of any kind , your neighbour could find himself with a large fine or worse be in jail , yes you should be very concerned about this issue .I have personal experience with this and it can cause you mountains of problems ,. I suggest that you have your surveyor check for the pin reset if needed but have the pin in place good luck

I went through something quite similar to your situation. My neighbor built a huge barn right out my back door (practically) and made a driveway beside it. In the process of putting in the driveway, they ran over/ removed the old property pin.
Well, my neighbor consistently ran over the corner of my property, when he pulled his boat. At first I put concrete blocks on the corner, that didnt matter, he just ran over them. Next I sunk a 4X4, I came home one day and noticed the 4X4 seemed shorter, I went out to look at it, and found he had broke it off below the surface of the ground, and stuck it back in.
My next step was to sink a piece of telephone pole, I sunk it about 4' and still had 6' sticking above the ground. It pissed him off so much (even though it was my property) he made plans to put up a fence, and block my access to half of a circle drive I share with another neighbor. He got a surveyor to come out, and I couldnt hear the conversation, but it was obvious he was pissed off about something. A few weeks later I found out (by the neighbor who shares the circle drive with me), that the angry neighbor found out he didnt even own any part of the circle driveway, therefor had no right to put up a fence.
Were now at a fragile peace, I dont speak to him and he doesnt speak to me.

When I took the developer to small claims court, I had all the paperwork, survey, etc to prove my case. I had also used references the Texas statutes that the developer had violated by tearing down the fence.The developer had an attorney and I represented myself. The attorney said that because my surveys and county documents etc were not certified by the county that under the rules of evidence they could not be allowed. I did not have a reply, and so the judge dismissed my suit w/o prejudice. The judge said that he did not have jurisdiction in this case anyway, and it belonged in a higher court. I think he did this to give me a second chance because I was at a loss to answer the attorney. Anyway I went to an attorney who took the case and he refiled it in civil court where we asked for more than double the original amount plus attorney's fees. My attorney also told me that rules of evidence don't apply in small claims court. The attorney for the developer tried to settle for a little less than the original amount, but I did not want any less than what we were asking. Prior to the court date they finally paid what we were asking.

Here I sit behind bars in cell Block C at the Adult Correctional Institution reflecting about what I did yesterday...

Kidding of course, just making a joke about this saga...because it really is a joke IMO!! This fruit cake of a neighbor is bent on trying to get under my skin. I honestly now believe he's hoping I snap and do something stupid. But that'll never happen...he'll die trying first. But no matter how much I ignore his childish antics, he continues to antagonize. As pissed as I was yesterday, I decided to spend most of the day in my garage doing tractor maintenance instead of dealing with this bafoon. Clear mind today and able to focus on what I want to do...move the trees and not getting pissed off looking at the mess he left me....again!

As for the mess--lets just say it involves his newly purchased leaf blower, leaves on his property and the mulch bed for the trees I just did this past summer. Prior to planting the additional 200 Arb's in 2007, the area between our 2 properties was wide open. His yard would be leaf free every fall due to the strong NW winds and end up in my property--specifically my pool area which left quite the mess and a lot of staining. Now that the trees are in place, he's stuck with all his leaves instead of me dealing with them. Last weekend while out searching for the boundary pins, I chuckled to myself about the mess in his driveway area...tons of leaves! Guess I laughed too soon because yesterday I noticed leaves and mulch blown into my yard next to the tree line and his driveway area spotless. He left one heck of a mess that's for sure! And he waits until I'm not home to do this kind of crap. Wouldn't be surprised to see it happen again because yesterday was extremely windy and his driveway is worse today than last weekend. The leaves are bad enough but to trash my mulch bed with his blower is enough to put me over the edge!! This is just one of many examples of his childish games. Another was with his last cut for the season. He literally plastered the tree line in his front yard with ground up leaves from his mower. I was so furious flames were coming out of my eyes, but somehow kept my temper intact. I just cleaned up the mess and got over it. I should have taken a picture!!

I've also come to the conclusion that dodgeman(I think it was him) was correct in saying this neighbor will never be happy no matter what I do. Short of removing the tree line in front of his house...and no way Jose will that ever happen. That row is planted correctly at 3' off the line and are permanent. Btw...recently discovered that in CT--tree lines, hedge rows and shrubs are specifically excluded from being subject to spite fence laws.
