Problems with Trespassers

You done that been there have ya ? You gonna guarantee him , the OP , that he will win the fist fight against all of them ? Can you guarantee him they won't be back every day to get even ? ever heard of vendettas...? Sometimes things have to be settled for good.

Vendettas ya have few still to settle . But for the most part it works .

Cops ain't working for him as most the time they don't .

His best would have been thought about this before he bought .

My uncles and aunts and dad have been in gun fights with each other over land that there parents owned . It was auctioned off at the court house and my dad bought it . That was in the '70's and to this day I still have problems with cousins and uncles . Over it as the think they all can trespass on it tell this day . Cops wouldn't help this whole time . Only thing that really help was that the main uncle finally shot someone for trespassing on land he was just hired to manage . He's in the pen now . So this is really a hard deal to give advice and for any one to handle .

And if the right way doesn't work you will have to try the wrong way . Of just move now and sell the land now . About all I can say .

So good luck .

Nearly 50 years ago my dad, a minister, was assigned to serve a group of churches in the far western part of the state. A group of bored 20 somethings decided to pick on the new preacher and his wife (who were not much older than the thugs). Threats to mom when dad was away, beer cans in the front yard, donuts in the yard, stolen stuff, broken windshields, gun shots in the night, broken parsonage windows.

Dad decided to purchase a small revolver from the hardware store. One afternoon when the thugs normally rode by, mom and dad were across the road at the mountain creek that ran right next to the road. They had milk cartons floating in the little pool there.

Mom waited until the jacka55e5 stopped and she shot six cartons with six shots. The thugs never bothered them again.

That's a real story, it planted enough doubt in their minds to never consider coming back. Well that and word probably got around that the preacher had bought a gun.

To the OP, deal with the thugs legally, swiftly and completely with every means possible. There's good advice in dealing with the sherriff's dept in a rational manner.

Arming yourself is a good suggestion making sure your wife is armed is also a good suggestion at least with mace/pepper spray/taser. Just make sure the carry isn't seen as an illusion. Take a concealed carry class-educate yourself on when and how to use your weapons. Practice shooting and leave the evidence around. I would think zombie targets with holes in the chest or head would make them think twice. And let them hear you shoot some just be absolutely sure your bullets are going in a safe direction.

Didnt read through all of this yet, but, just in your first post - The cops are full of it. YOU have the deed so YOU own the land. The cops should have issued citations for trespassing and destruction of property (signs). Then, someone should have been arrested for assult, several times. Using an ATV to push or harass IS assault with a deadly weapon. Pushing is assault and battery.

If the locals wont do anything, call the State Police..

Then buy a shotgun..

Gotta think that the first party to introduce a firearm into this dispute loses. Not to say I wouldn't have one, but it sure needs to be last resort. Castle laws notwithstanding, it's going to be one hearsay against the other when you get to court. And the tough boys may welcome the escalation after a few beers; clowns like that are likely to have a gun around.

I like the personal visit to the PD and ask for advice scenario, and I would go the game cameras one better with live and recorded video surveillance. But then I like that sort of thing (CCTV). I guess I would also be looking at sales opportunities for that there property, but it's easy to say since I have no stake in the place.

The thing with castle laws is - It happens on your land in your castle! There is no 'hearsay'..

Not sure I would give a warning shot. Just seen on the news the other day where a man was arrested for giving a warning shot to a person trying to break in his house.

Ya, but wasnt that because he was in a crowded are and put others in danger? This is open land far from other homes.

A "warning" shot is an admission that your life was not in imminent danger, and that the use of deadly force was not necessary. By definition, it is an effort to intimidate.

Using a firearm to intimidate is most likely some sort of crime in your state. Don't let internet heroes and testosterone goad you into doing something that you may regret the rest of your life.

I would have shot those idiots in the first go round. One verbal warning and kill one of these losers. If the others advance, kill them all.The police will know whose land they were on when they are still laying there. Playing grab A** is what these fools want. End it.

True story..

When I bought this land, I had problems with 'friends' of the previous owner just stopping by. Several times, I woke up to a face looking into my windows! Anyways, after telling 10-15 of them that I live here now, I started having problems with 'scrappers'. One day I noticed a truck trying trying to sneak into the back at 1 in the afternoon (no one's at home at 1pm, right?). I went out there and confronted the guys. 'Oh, we were gonna come to the house'. Sure. After telling them several times I have nothing I want to get rid of, the first guy starts coming closer to me and the second steps out of the truck. At this point I asked 'Is lead recyclable? I have plenty of that you can have' and opened my shirt to show off the 9mm strapped to my waist.

Never had another problem.. Been nine years now. :)

A legal shot will still cost about $10 grand in legal fees. You will be arrested and have to spend many hours, days, weeks, months, in the legal system. A shot is to be avoided at all costs short of immediate harm to you and yours.
