Actually, the old guy is trying to play it down. I don't think he called into the station just to tell them "I was fired for breaking the rules and I agree I broke the rules."

I believe it was someone outside of the situation hearing he'd been fired for giving a muffin away and the story made news before anyone could get out in front of it. He made his statement, he's cool with it. CB made their statement, it's merely a policy thing. Make your own choices but let the story that shouldn't have been a story fade. Last thing he needs is his name becoming commonplace and preventing him from getting another job. This connected world we live in has turned everyone into 'gossip-hounds'... It is a non-story...

As I said, he MAY have cause, its all in how a court looks at the whole of the story.

In my experience most employers would steer away from a statement like that as far as possible.

Either the manager who made the statement is not very experienced or they are more scared of the story than they are a lawsuit!
The only way he would have cause for discrimination would be if he could prove another employee was warned 5 times or more and not fired. It looks like they (CB) were more than fair with him. Employees giving away product regardless of how well intentioned cant be tolerated if the business wants to stay in business.
I no longer frequent cracker barrel mainly because the food quality over the years has really gone downhill.

I don't think discrimination is the issue. I see it as a breach of employee confidentiality no matter what is already out there.

Giving away your own stuff is charity. Giving away somebody else's stuff is theft. Doing it 5 times is chronic theft. Doing it 4 times after being told not to is stupid. Being a vet is immaterial to the "story".

I have no problem with violating a thief's 'confidentiality'. There should be consequences to that kind of behavior. Victim's rights trump criminal's rights in my house.
