This is exactly why the OP does not want to lawyer up as some are suggesting. There is no way the land in question is worth what a lawyer will charge to attempt to save it (key word: attempt). I wonder how many suggesting legal action have ever footed the bill for that advice, not many I expect.

A lawyer is worth asking about the situation, what laws apply, what rights does he have, etc. Getting the information to empower oneself doesn't mean committing to an expensive legal proceeding.

Consult a lawyer, yes, that's sage advise. The term being used repeatedly is "Get (which by most definition means "obtain") a lawyer" sounding as if going to court is a good option. It's not unless you have money you don't know what to do with, and then it's still not.

Agree.

The water people are concerned about their best interests and not yours. With eminent domain they can take the land but not set the price. We went through this and hired a lawyer. The lawyer tripled the price of the land. There are lawyers that specialize in this sort of thing.

Ok more info found out. Public records are so fun

Lakes guy ask state if he had rights to the land they clearly said no
Permit filed with his name as land owner after that
Environmental study done the said hold added water in the lake will help nothing as lake is too small

Plans for permits show all houses on lake but mine so to make it look like all they affected was empty land

Swiftmud permit says it can't affect anyone
I had them out and they seem to know this is wrong but have to run it up their chain of command

If you sit down at a table with Swiftmud (whatever a Swiftmud is) and they have lawyer sitting there and you don't I doubt that day will be very productive for you.

Yep, whole thread is a little light on punctuation and precision spelling. It is a little tough to read. Overall, I generally pass over these but it's bothersome.

On the thread topic, I advise that the OP become as educated as possible on the law surrounding the lake, water rights, property rights, at local/state/national level. The courthouse property maps, other maps as suggested, and the internet should provide access to applicable current and past laws and court judgments. This may uncover a legal foundation for fighting the proposed change. Agreed, retaining a lawyer would likely be prohibitively expensive. Perhaps you can find someone willing do do some pro bono work.

Look if you can't spell CREEK you need a lawyer!
