As for the ruling, if you buy a pistol and use it as a hammer to pound in nails, the pistol manufacturer cannot sue you and tell you not to use the pistol as a hammer.

I will never forget the day when the Snap On guy walked up and caught me pounding on a screwdriver with a ratchet. He exclaimed that was NOT a hammer and NOT a chisel. I just looked up with a big ol grin and said but they are guaranteed for LIFE! I think I was about 22. ROFL

You will be leasing tractors instead of buying them like Microsoft is doing with their
software.

Yeah, we'll see how that works out for them. It's one thing for the big corporate farms to lease equipment, probably makes some economic sense. Not so much for what I'd guess to be the majority of TBN members. Sort of like leasing a car...only makes sense for someone who trades every couple years anyway.

Same thing with MS software, mostly corporate users who can write off the lease payments as a business expense.

I think what you will see, assuming the software type rulings go the same way, is that you will see more denial of warranty claims made. JD will state that you modified the software and thus voided warranty. Manguson-Moss act says they cannot void the warranty if you buy consumables from other sources. However they can say that the Hydro fluid you bought from TSC did not meet the standard they need and thus the warranty is void.

Warranties are for a very limited time, software locks are forever.

When I had my foreign auto shop I went to an auction of a dealer who was selling off his inventory of shop tools. I bought a complete set of Snap-On pullers on a wallboard. When My dealer came by he flipped, because he now had to warrantee the set forever, even though I had bought them for next to nothing. Oh, well. I guess it made up for all the tools I'd bought at 'retail' off his truck for many years.:confused3:

When I bought my tractor 12 years ago I bought the simplest most basic machine I could find. I did it for this very reason. I wanted to be able to work on it myself. That decision has been the best one I've made in a long time and for reasons I could have never foreseen (like this software deal). I was part smart, big part lucky. But so happy now. Can't even imagine why a SCUT or even a CUT needs a computer!

Pretty soon I'll be shopping for a new tractor. Any manufacturer that has a software lock will not be considered.

I keep on getting trade in bonus offers in the mail from Deere wanting my Kubotas for trade, all pre tier 4 equipment do they really think I would give it up my equipment for the under engineered Deere garbage sub compacts. Want to take the mailer into the dealer and tell them to take me off the mailing list.

Brand issues aside, I consider my pre tier 4 tractor to be priceless. Anyone wanting to buy it would pay a premium.
