I think the question is quite the opposite. Where is the personal responsibility? Those days are gone apparently.

The operator should be responsible to educate himself with the information at hand. Maybe a hundred years ago a new cowboy should have been able to sue the guy that sold him the horse that bucked him off and broke his neck?

Not a child we are talking about here. Oh wait... maybe we do need nannies for adults? And we call this social progress?

I agree somewhat, but... I know from experience that my Kubota MX 5100 should NEVER leave the dealership without loaded tires at a minimum, and wheel weights. It is notorious for being too light in the rear for fel work. There needs to be some compromise here that covers that scenario. Seriously, maybe we need a tractor safety course before taking delivery. :confused3:

The operator is responsible for educating himself. To do research and to ask questions. People are responsible for their own actions. What made him think he was educated enough to operate a tractor?. What would make him think he is educated enough to operate a firearm? Same thing.

I agree with you, but... again, how do you know what you don't know??? Most of us boomers on here grew up doing this sort of thing; but what about the numb nuts home owner who just got 5 acres and a zero turn in the same week? Shoot, my own white headed father swung a leg over his craftsman riding mower kicking it into gear with the mower engaged... chewed up half of his lawn furniture, shrubs, and fence before he got it shut off.

I kind of get a kick out of people saying they would never sue. So a friend with no substantial resources gets paralized from the neck down while working with you on your property. What other choice does the poor #$%$$ have? Are you going to pay for his healthcare and keep him alive in some decent manner for the rest of his days?

Seems the owner did not make sure he got what he paid for. Careless to not do so. Waste of money. Sadly in this case apparently it contributed to loss of life.

ACTUALLY, if you saw the documentary on that, you might change your mind. And she is DEAD and gone now, but you couldn't even begin to imagine the severity of that particular injury.

My dad runs his sprinter with oem all season tires, probably 200,000K on them, and the insurance company gives him a snow tire discount because he told them over the phone that they have a snow flake on them! Nothing ever seems clearly thought out.

As with all stories, not all information is included. The original link doesn't mention ROPS or SEAT BELT. Things like that, if properly used could well have saved a life. Those items specifically omitted by lawyers may have given the jury false information. Unless one was there, won't know.

I also saw "the rest of the story" with the burned woman. It was very severe and nothing to joke about.
