"That is a mute point" would indicate that nobody could hear it rather than it being doubtful or no longer relevant.

They are both proper words. Founder is related to laminitis in horses as you mention; flounder means to flop around clumsily or helplessly. Sounds pretty accurate in describing many government programs.
Then I wonder if the use of "founder" or "flounder" would be a regional thing. Pretty sure those in the southwest wouldn't know anything about a sideways fish.

I've heard it a million times. I think it was a product of the times and the very rural area where I lived.

Ethyl was the higher octane.
