It doesn't matter where the lines are; easement, right of way, or in your back yard. If you dig into the ground and damage a public utility line, you are liable for it's repair if you haven't called Digsafe.

I do however disagree that one should be libale for lines that are on property where they don't belong and have no right to be there in the first place.
