Well I gota say I thought I might be over reacting. I would like to say a few things in general. Yesterday they were using my land as it was theirs to drive out and in. They have there own drive, so I put a telephone pole down to stop that. I believe they might have thought they were going to show me. In regards to the car, I have not directly confronted them on it. But I will Because I intend on having it towed on Monday, if not moved. Other then that I attend on having nothing to do with these people. The Dozer thought did cross my mind JohnM. I was gonna park with the blade right on the car as close as I could, but figured that would be going down on there level completely. I really dont want to fight with these people but I want What I paid for Period. As far as renting I thought the same thing but Iam really pretty bent the way there acting so the Heck with them. My fence and future goats :) will be staying about 40' from there front door. Well as before I wasnt gonna fence it like that.

Appreciate the responses, and because of other posts on this subject I took this a little more serious then I believe I woulda before.

For what it's worth, my municipality has an 'abandoned vehicle' ordinance which allows them to be tagged (nice, big, bright orange things) and, if not moved in the statutory time listed on the tag, then towed away by the municipality. You might want to check to see if your municipality has such an ordinance.

Another option might be to call the local law enforcement (sheriff?) and see what they do with abandoned vehicles on the property of others. You might find some help there.

Of course, as a last resort, you can always pay an attorney to do the research for you but the answer you'll get is likely going to be fraught with so many "but if's" and "however's" that you may end up knowing less than you do know. I'm finding that kind of thinking creeping into my daughter's lexicon the further through law school she gets. /w3tcompact/icons/eyes.gif

Just a thought here which you already probably checked out. You look to be okay legal wise all the way -unless- there is an easement restriction on the deed. If the prior owner granted a easement, it transfers with the land (if it was recorded).

Thats something we definitely checked there was none recorded. The prior owner granted use (verbal) while he was the owner. He didnt live there anyway.

We live out in the sticks so theres no city ord. but I did call the tow company to check and they will remove and store vehicles on your property. The owner if they want them then have to pay all the fees to get them back. I have videoed everything and will do so when the truck arrives if it gets that far.

While not NECESSARY before towing it would help your case IF it ever winds up in court, to have sent a certified letter, return receipt requested, to them advising them there car is on your land, give them time to remove or it will be towed on such and such a day. Probably overkill but in a judges eyes it shows you took every reasonable option and THEY are the people being putzes!

I really considered that. Hopefully they will just remove it, if not Iam gonna roll the dice then.

Theres a few other things also; half of another car is across the line, they have there spray head for the septic about 1' from the property line. So that it sprays on my property. This I know for a fact is illegal. I have spoke to them about that. They said they would not move and Blah blah blah. So that is the other outstanding issues.

I agree with you 100%, Ranchman. John's neighbors are not being very neighborly. Coddling them will just play into their hands, give their false claims credibility and accomplish nothing for John except cause him unnecessary anger, frustration and worry. Good fences make good neighbors and if the neighbors ain't good, the higher the fence the better.

Just getting in. If you give then a foot they will take fifty feet and pretty soon you will end up like mdbarb is with the crazy neighbor.

I bought my land, I pay my taxes and that is that. I will post it protect it and prosecute those who tresspass on it. I would have your "good attorney" send them a formal notice of removal on the vehicles and confirming their rights on the ingress/egress of the access road.

Sounds to me like they will be a major pain to deal with long term and sometimes good fences make the best neighbors (the fence that is).

I see you just couldn't keep your word about not ever posting on TBN again after you sent me an email saying just that after we took our "discussion" out of the "public eye." I guess words like "never" are relative to you - meaning until you change your mind. See you also changed your handle - wanting to "sneak in" under the radar I suppose, "Clean slate" perhaps? Can't say either really surprises me though. /w3tcompact/icons/sad.gif

Yep, our favorite criminal (trespasser) is back - wanting to give away OTHER PEOPLE'S LAND because the "rich" (i.e. anyone who owns land) are evil and the criminals (like himself) who choose to trespass are the real "good guys."

Yep - sorry to disappoint you, poor " 'ol Ranchman" just can't let it go with regards to criminal activity. Never liked it, never will. Guess I'm just a big 'ol "mean-ee", those poor, deprived, misunderstood criminal elements of society - after all, it isn't THEIR fault, right 'ol "buddy?"

Imagine, the AUDACITY of someone like me saying people should be held responsible for their criminal actions - Yup - I'm the REAL reason for the downfall of society. Imagine, thinking that LAWS should be obeyed and criminals shouldn't be thanked for breaking the laws designed to protect me. (That is what your post on the old thread said at least.) Yep, I must be positively evil! /w3tcompact/icons/eyes.gif

As to my "friends" growing up, well, suffice to say I had 'em then and have 'em now. Sorry to disappoint you - course, I didn't associate with thieves and lawbreakers, I suppose I could have expanded my "friend base" if I had - guess I go after "quality" instead of "quantity."

So, last time we spoke, you told me about those couple of times you got caught on someone else's property, (or was it just the one time you spent the night in jail? Wern't you already in the Army by that time? Stealing from someone's garden or something like that? ) How many times have you been on someone else's place without permission since we last spoke? How many times have you been "spot-lighting" 'ol "bucky?" Come, on... I KNOW you have....fess up... I'm not in law enforcement (any more) after all...

Oh, BTW, a first time offense of poaching (a FELONY) in Texas can gets you 180 days to 2 years and up to $10,000 fine. A second conviction carries a mandatory minimum of 2 years, going all the way to 10. (of course all of this passed the legislature a couple of years back due to "evil" folks like myself fed up with low-lives stealing game.) That's for poaching. For just plain 'ol criminal trespass (hopping a fence or such - no sign required) without a weapon, the penalties are a lighter - 1 year/$4000. 'Course, if you're carrying a gun or your hunting knife, welp, penalties rise. So you might not want to hop the Red River for a day of "fun" or move to Texas any time soon - we don't care for criminals much here - not sure that your "activities" would be looked on favorably 'round these parts.

BTW, I plan on going dove hunting tomorrow <opening day in North Texas>, course I’m going someplace where I have permission and I’m legally authorized (and it ain’t even my place! WOW! /w3tcompact/icons/shocked.gif) I assume you are going "hunting" too. ‘Course I suppose you won’t even fool around with licensing, seasons & such, or stick to land you have permission to use - after all, that stuff doesn't apply to ‘you’, does it? After all, they're just "silly laws." (You might want to check with the Oklahoma authorities - I think they too take a dim view of poaching as they have instituted "Operation Game Thief" like we have here in Texas.)

No Kerr, I didn't "lay down and take it" with regards to you're advocating criminal activity last time, so don't count on me doing it again this time either. Sorry to disappoint you. /w3tcompact/icons/sad.gif
