Soundguy may be correct. Why does an ag tenant, who has the limited right to grow crops, have any complaint about harvesting deer? Seems to me the ag tenant has the right to plant, tend, and harvest, but if your hunting does not interfere with his planting, tending, or harvesting, he should stand down.

Something doesn't add up in this story because how does the ag tenant claim he was damaged?

Pursuit of game not mortally wounded may be a difference.

If you lease to farm (not hunt),you own the property so no trespass.Common sense and good neighbors would allow any-one to pursue "wounded"game,I would expect the same treatment.I hunt near neighboring property all the time,I have had it happen to me.Laws do vary by state...check your regs if you have a problem with a neighbor;never hurts to call you local game commission.

I had a bad experience with individuals wanting to hunt for free on property I had leased to hunt on. When I wouldnt give them permission, they stole some timber off of my private property in an attempt to 'teach me a lesson'. Reported the theft to the Sherrifs department and they began an investigation. The theives went to some of my neighbors and 'suggested' that they not get involved if they were asked any questions by the Sherrif's department. One of the thugs even threatened me with physical harm to myself and my family (wife and small children) for 'messing' with them by calling the 'cops' - which I also reported to the Sherrifs office. Needless to say, the investigation went no where. Several years later, I found tracks across my private property where the timber had been stolen and also some more property that I had leased. Set up a game camera and wound up taking photos of the guy who had threatened harm to me and my family. Took the photos to Sherrifs office and asked them to charge the individual with trespassing. They were extremely reluctant to do this and tried to discourage me by offering to go 'warn' the individual to stay off my property. I declined their offer and related the past history with this individual. Finally got an appointment @ the District Attorney's office and things started happening. Several months later, the individual pled guilty to trespassing and was sentenced. The Judge suspended the sentence and placed him on supervised probation for 6 months, ordered him to pay a fine, court costs, probation costs, indigent defense fund costs, was ordered to have no contact with me or my family and to stay off of any of my property. So far, there have been no further incidents with this individual. Have had to talk to a few of his friends who felt like they were entitled to utilize the property I have leased. Discussed those incidents with the Sherrifs office and they had some conversations with the individuals - who then decided to be a little more courteous in the future. Didn't like having to go to such lengths, but if you don't stand up for your own property and what's right, some people will run all over you. Sorry for the lengthy post, just a condensed account of what happened to me and I hope none of you all ever have anything like this happen to you.

The problem I've had when they cross my fence. They damage it or cut it down to retrieve their kill. That's when I will enforce and prosecute any and all tresspassers regardless of reason. All they had to do is drive up and ask permission.

In NH we are told in hunter safety class to call the local Fish & Game LEO and he will come and recover the wounded deer on the posted property

Wow....those conservation officers would be pretty busy here in MN. Lotsa those kind of issues here....and you can enter anothe guy's property to retrieve wounded game.

Almost every year my neighbor calls me to (attempt to) retrieve a deer that he shot on his land and it made a beeline for mine. Strange thing....he's never found the deer that he's shot at. He hunts our property line....and I wish he could shoot better. Still...he is an honest guy and is doing the right thing.

HI Guys:

In Ohio w my cus-n-law and his at the time 14yr old boy. this was maybe 1995 the boy shot his 1st deer a BIG buck. His stand was about 50 feet from property line the deer made it about 10 feet inside other side of the line over a fence. They old thought was it was wounded game belonged to shooter if it was withing sight it was OK. the two of them were going over the fence and were stopped by AH neighbor. He claimed they shot it on his property (no real blood trail game warden arrived 15 min later.) they took both guns the deer was given to the AH neighbor and he lost hunting rights for 5 yrs along with $1500 fine!

Anyhow most people here would be OK with retrieval of wounded game but then you have a lot of AH's too.
