Might seem like a simple solution however I think you are greatly under estimating the situation these people were placed in by the operator. I would not be surprised if many of the victims did know how to swim. I've been on the Ducks at Lake of the Ozarks and on the lake several times. Looking at the conditions in the video these people would have had near-zero visibility, would have been difficult if not impossible to hear anything, and very difficult to move on that vessel. Add in the fact that you would have to exit through the side windows and most likely without a*life*jacket*attached in order to keep from being pinned to the canopy above. Wet and heavy clothes and large waves added to the mix and I'm not surprised at all to see the number of victims. Very sad situation that they should never have been placed in.

Yes, very sad. But they were willing participants. People have to assume some personal responsibility when undertaking activities with inherent risk. Anything on water or in the air has greater potential for an accident.

I have been on small boats that had incidents that could have been tragic, and have pretty much zero interest on getting on a boat unless it's necessary.

Well of course but that is not going to matter much when the lawsuits stack up. The Ride the Duck company as professionals are going to be held responsible and the municipality for permitting the business is going to be held responsible since these boats are known hazards. Someone issued that captains license and probably renewed it...... this is well over a $100 Million lawsuit. Who ends up paying when municipalities get sued? Taxpayers.

I don't like flying because I HATE relinquishing all control. You are the reason for the conveyance, yet are treated like cargo and especially nowadays they better not hear a peep out of you, or the authorities will be waiting to arrest you.

People make mistakes. I make mistakes.

So now, basically a bunch of lawyers get RICH off this tragedy.

Transportation is maybe a little different. But it kills me, when the average person is incapable of providing their own entertainment or "thrills" and rely on others to provide it, and then hold that party "totally" responsible when something happens.

I bet this puts them under, their insurance alone will skyrocket let alone legal costs.
