Right by where the Branson Belle docks. Between moonshine beach and the state park marina

Well of course but that is not going to matter much when the lawsuits stack up. The Ride the Duck company as professionals are going to be held responsible and the municipality for permitting the business is going to be held responsible since these boats are known hazards. Someone issued that captains license and probably renewed it...... this is well over a $100 Million lawsuit. Who ends up paying when municipalities get sued? Taxpayers.

I don't think the municipality will be hit, the Coast Guard issued the captains license.

Don稚 see municipal liability here. Boat went out in bad weather and sank.
On side note there was a drowning near here last year. Couple had a pool party and none of the 15 plus adults at party could swim. It took a long time for fire dept to arrive and pull kid out of pool

Maybe not. But the municipality issued a permit to operate a business with a known documented history of accidents and fatalities. All businesses have liabilities but this one is beyond the pail.

Who knows who will sue whom and for what in this litigious society, but this business "Ride the Ducks" hasn't had any problems or documented history of accidents that I know of. I think the accidents in Arkansas and PA and WA were likely owned by different business's. The fact that there have been automotive accidents on dry land do not necessarily show negligence of a municipality licensing a business, nor the accidents on the waterways either. I don't even think the operation of the Ducks is all that dangerous. Sure the Ducks are getting very old, but if inspections are regularly performed and repairs and replacement parts fade, then they should be safe enough even if operated for a thousand years. There might not be any actual parts and pieces from the original still in use, but that would be fine.

If on a jury, I would see no liability to the municipality or the original manufacture of the DUKW (GM). The fault lies in the idiot or idiots that knew a storm was coming in, and decided to make that last run. Why did they make that last run? Because they wanted the approximately $850 in revenue.

As near as I can tell, some of the "ducks" are new construction, with a mix of the original DUKW machines. I believe the one that capsized and sank was an original DUKW made in 1944.

It needs to be the "end". Those things were built for war not for commercial use.

Are the "new" or "modified" ducks just made bigger to hold more people? I don't remember the WI Dells ducks holding that many people.
