Around here you can only go for $4000 in small claims. I dont think I can hire anyone to fix this for that.

But, wont it still look like bird poop spots everywhere even after sanding when I seal it?

Yes, but stained concrete looks marbled anyway. I don't think you'll notice, but I'm not that particular. Did the contractor ask if you would be staining the floor or did you tell him. We don't spend time covering floors that will have something over them much like sheetrockers don't protect from mud spills and painters don't protect from overspray. Having said that we do ask and write on the studs in the room if it will have stain or have flooring.

In CA I can hire day labor for $12.50/hr, in Grants Pass $10/hr will do.

I suspect Kansas is closer to $10. You can probably rent a floor sander, buy all the supplies necessary, and still have enough left over to pay for 200 to 300 hours of labor. That is a powerful lot of floor sanding.

But, I would give the guy who did it a chance to clean it up first.

Just so happen a basement I did once hired out the drywall work, the sub foreman went and spray bright neon paint on the cement at every overhead light and at the wall on the floor where every receptacle was located, as well as where the heat/air registers were,
this was standard for him to go ahead of his crew and mark out things to be sure nothing was left covered up, He had no problem removing it when I told him we were staining the floors
Plus it helped by holding his check
But as i mentioned earlier the stain floor contractor will usually do a bit of sanding himself, if you are having this done ask him how much of this can he get up by him sanding?

I'm not talking about staining it, I want to seal it with a clear sealer. I had better go re-read my replies. I might have said 'stain' instead of 'seal'.

The guy called back and said he turned it in to his insurance company. They are to call me next week. Have no idea what they are thinking.

The foam man turned this in to his insurance company. Adjuster should be here today. I hope he understands how bad this stuff is to remove.

I am planning to spray some foam this summer, after reading this I am going to buy a lot of drop cloths.
