If you meant to say, the only time a manufacturer does a recall after a unit is out of warranty, is if it is a safety issue, that is generally true.

If you meant to say, manufacturers only do recalls when it's a safety issue. That is incorrect. While injury claims are a strong motivator, manufacturers do recall products to repair flaws in designs, and manufacturing. Particularly, when they care about their reputation.

This defect was know when these units were still under warranty, and it is a serious enough defect that it required them to not only change the pump to one with a longer shaft, but apparently those who have gone through this have said they also modified the gear it drives.

There is an implied warranty of fitness when you buy a product. This means the item is fit for the use that it was intended for. A case can be made these units were not fit for such use. Time will tell, but it's starting to look like the fact that the remaining units are getting used infrequently is the main reason they have not yet failed. If the company knew these units had this fatal defect, kept selling them, and did nothing to correct them, a case could be made for fraud.

Since the gear has been quietly modified to correct their mistake, would just replacing that, keep the rest from failing? Does the pump have to go too? Or, should I just wait for it to blow, and become a lawn ornament? (In which case it will be parked on a main street, with a big yellow lemon painted on it).

Anyone have part numbers for the gear, and the longer pump?

I have the numbers, I will post them for you.

I would like to use the argument that it COULD be safety related. What if I was going up/down hill with a load in the bucket, say only 300lbs. WHAT HAPPENS IF MY DRIVE FAILS THEN???!!! run away tractor WITH A LOAD!!!? how is this NOT safety related?!

You can avoid someone to asking you to clarify your point, if you make it more clear.

I dont remember any manufacturer imposing a recall for anything other than a safety issue? Take my tractor for instance, I never got a recall on the radiator hose or steering pump bracket yet I fixed them myself. I only heard about it from this site. My Jeeps only had recalls when there were issues with things like the ABS breaks, or seat belt or steering wheel defects-all safety issues and all out of warranty.

That doesn't mean it never happens.

I have done lots of warranty work over the years, not all of it was for safety.

They don't necessarily send you a notice. They may wait for you to ask. That's called a silent recall.

Kubota once offered replacement seats for BX owners, due to complaints about the covering.

This is all irrelevant semantics here, nothing is prevents MF from handling this problem, if they wanted too.

The pump was replaced and actually they changed the hub the spline went into for greater shaft penetration. The Dealer did all of the labor for free. The manufacturer covered the parts. GREAT DEALER!!!!!:):thumbsup:

Woo-Hoo! I'd say some sort of gift --maybe a box of donuts and a jug of Java-- would be in order for your dealer and his mechanics!:thumbsup:

Forgive me if I am skeptical of the statement, "The dealer did it for free".

Are you certain they did not get MF to cover the labor? Three months out of warranty, it's not unheard of for them to do that.
