Its all part of the price increase that Idaho placed on forest and lake land last year. Ive been told that leased lake front rates have doubled since last year also.

I 2nd the call to the department involved. see if theres a hardship clause you can apply for.

State congressman and senators are always an easy thing to get ahold of. they all have email addresses. I have always had them contact me back after ive sent them messages.

I don't know if I would want to test it but I bet they can't do much more than put a lien on your property or your tax refund (if you get one). Just blocking the road will be a legal challenge for them probably landing them in court to get permission. If it was raw land or even a part time use hunting cabin then it would be easy but there are laws about blocking emergency vehicles from accessing homesteads that even the government can't easily violate. It's one thing to prevent you from building the road but that's not the case. A lawer would most likely know but would cost you more than just paying the fee (that's what they count on).

There must be a way to just give the road back to the Forest Service. It is on their property, after all.
Then force them to maintain it as the primary (historical) access to your property.

So do I understand correctly? You have a legal easement to the property on an adjoining farm property but let it go back to farm land and use a federal forest service road with a "special use permit" instead? They now want to charge you a processing fee to renew the permit because it was not renewed in the required time? You didn't renew the permit, yet continued to pay $100 per year, because you didn't know it required renewal? Just trying to understand the big picture.

If they block your road they are depriving you of emergency medical services, emergency fire service and emergency protection from law enforcement officers.

It sounds like you are being billed a one-time fee for a 20-year renewal review of your access road use permit. You may have owed that in any case, not just because you forgot it.

I guess you are mad because you don't see the value of the 20-year review? On the other hand, the FS is responsible for knowing what is going on the lands they manage. If they don't manage them, that would be a problem too.

It sounds like you are being billed a one-time fee for a 20-year renewal review of your access road use permit. You may have owed that in any case, not just because you forgot it.

I guess you are mad because you don't see the value of the 20-year review? On the other hand, the FS is responsible for knowing what is going on the lands they manage. If they don't manage them, that would be a problem too.

I already do understand the process. We always paid the annual fee. Congress has allowed them to collect these formal application fees and I wouldn't have a problem with it, it's just that $410 in one hit is a bit much, especially for a disabled senior citizen living on $465 a month. They could have added it to the yearly fee, or given a person a 90 day period to pay, or just been a bit more reasonable with the amount demanded. I don't know, maybe I'm a bit old fashioned, maybe I'm high, but $410 being demanded in 3 weeks, well, it kinda pisses me off! I realize it's our problem and we'll work through it, but it's an outrage is all. Just kina felt that they could have been more flexible, or sent us notice back in 2006 when they decided to change the law.

I would at least ask if they are sure this applies to your case. Computers spit these letters out and it's possible no human eyes were ever laid upon it. Information is your friend.

No no, by that statement, I just meant that they were talking in the letter like as if we had submitted a proposal for this formal application, which we havent. In my mind, it should be a renewal if anything. It's all in the symantics I suppose. Sorry for the confusion. I've got the language of the letter in mind, but you all havent seen it, apart from my discription. We'll figure this out in time. I was just hopeful that we might have had an industry insider in our midst that could offer good info.
