I know what you mean about the humor if it wasn't for the expense. I was deposed on my case this morning and had to sit and watch this pup lawyer spend time looking through every document he had in a file almost a foot thick for one piece of paper he never did find. He was woefully unprepared which would have been fine were it not for the fact that what could easily have been a 60-75 minute deposition turned into over four hours of billable time for my attorney. Half the stuff he wanted I'd have gladly stipulated as accurate had he simply asked.

When you say he canceled, I am assuming that your neighbor went camping not his lawyer.

As I said earlier I really don’t think this guy or his attorney ever wanted to go to court or mediation or anything else. Your neighbor may have been hoping that he could just wear you down.

I know a judge in our area who would be very angry that these characters had wasted the courts time. Be sure that your attorney has all his billable time up to date at the hearing on the 13th. If they are a no show again, have your attorney ask the court to award your costs. It has worked a few times in our area if you have the right judge.

I agree with Tim and would have all my expenses and time well documented before the hearing. Judges around here get very vindictive when someone is wasting the courts time by not showing or filing BS cases like this. They will often make sure you are compensated for all the grief and expense you have gone through just to make sure they don’t see this guy again.

Good freakin question.
Today I looked over his "discovery" comments and he his claiming damages for, among other things, a bad bad by going over the speed bumps, a missing irrigation timer (?) and damage to a flap gate on the levee that is beyond both our properties on stata property.
He never ceaeses to amaze me.
What the heck does almost anything he has said have to do with anything?

Next he'll get the EPA, ELF, ALF, Raplh (Nadar) and the tree huggers involved since you just let your tractor sit there at idle all day. Shame on you, you radical land owning, mechanical polluting irresponsible ingrate Republican. Oh-oh, now he has justification for UN involvement.

Which caused me duress as a noxious fume of diesel gas like quality permiated my air space. This causing me to misplace the locality of my timer, which I was using to irrigate another "good" friends property. Since I could not find said timer, in a timely fashion, I jumped into my car, causing yet more duress to self and automobile as I hit said speed bump in excess of posted speed by 1mph. See speedometer calibration attached.
The jolt threw me from my vehicle and I sucummed to the prior said odor, as this menacing machine stared me down as I lost all consciousness. Thus the reason for my actions.

Again, not to be taken seriously... but can you see how twisted it gets.
