Can't say I'm a democrat either. Their to conservative.
Actually used to be a dues paying member of the apathetic Party.
But then I just sort of lost interest...

mdbarb,

Next your neighbor will sue for noise pollution due the tractor being used before noon on Sunday or some other crazy notion. I hope the judge nails him but good, one thing if a judgement for damages is made in your favor and he fails to pay (one can only hope) is to put a lien on his home and try to get him that way. That would be fun.

MD.

A lien won't do anything unless he tries to sell. The lien can sit there for years.

It is true that a lien can sit for years but my experience has been that it gets peoples attention real fast. We have had to do it a couple of times in the last 20 years on construction projects that people didn’t feel they needed to pay for. A lien will also see that no refinancing or equity loans are going to be made until the lien is cleared from the deed. Interest can also be charged if the judgement isn’t settled in a timely manner.

and he'll include all truckers in the class-action suit since they never turn their rigs off.
The case will be heard in Texas and the jury will award $87 quadrillion bucks! And several quintillion for emotional damage. Punitive damages will be assessed as the entire real estate of the United States plus arable portions of Canada.

Mark,

You posted what I was thinking but forgot to add. The lien will make their life a nightmare due to no refinance, no home equity, no sale, no kidding. It also goes into the paper and joy o joy, the bank won' t like it either.

Enough already.

Enough already.
People like this understand only one thing. Get a couple of your buddies to make the motor home dissapear without your knowledge. Have them smash his car in the Walmart parking lot, and do other things that will cause him instant pain and costly anguish. Make sure you are not involved in the least. We are involved in one of these kinds of "Stupid" lawsuits and it is so frustrating. The judges, if they had any balls what so-ever, would throw this thing so far out of court, it would'nt be funny. I say bring back the good ole days where you take this guy behind the wood shed and give him a quality lesson in being a good neighbor. I am fed up with these outragious court actions spending all my tax dollars and keeping the real problems tied up for years.
Sorry, just a little emotional about this.
My story real quick.
My mothers boyfriend moved out of her house and left all his stuff there. She askeed him to get it out, but he refused. I asked an attorny if I could throw it in the trash. I would be sued, using the tenant laws in place. After one year, and my mother not being able to move from that residence because the guy woud'nt know where to retreive his stuff, I got pissed.
Notified guy we were being evicted and his stuff would be on the lawn on this date. He got off his [censored] and came to get it. Me and my brothers were all there "helping" him lift the heavy items. I simply can't remember how much stuff got broken that day.

Re: Enough already.

I had a similar situation with one of my apartment buildings years ago. A couple rented from me with 4 kids. The husband gets sent off to jail for DUI and the wife takes the kids and starts shacking up with her brother-in-law across town and leaves the apartment full of her belongings and tons of trash. Real nice woman, here husbands rotting away in jail and she's sleeping with his brother!

I repeatedly asked her to come and clean out the apartment and she refused. After 2 months of no rent I took my truck and spent the entire day hauling everything from the apartment across town to where she was living and dumped it in the front yard. I then went to the post office and sent a certified letter stating that "per her verbal request" I had delivered her belongings to her new address.

When I got home that night there was a message on my machine from her boy friend calling me every name in the book and threatening to sue me for dumping on his lawn. The next morning I got a call from the city inspector asking me why there was a mountain of trash in front of MY apartment building. It seems that overnight they hauled all the sh&t back and dumped it in from of my building. I told my side of the story to the inspector and faxed him a copy of the certified letter that I sent and he went and fined them $500 for public dumping. I was then able to go and haul everything to the dump without fear of repercussion!

Then I got a judgment against them for back rent and expenses. Of course I was never able to collect it but that's another story...
