mdbarb,
Can you get pictures of the trench, property line, and
other reference points?
I had a neighbor who through his own stupidity lost track of
the property lines. I had a survey crew remark a our
common liine as well as the lot lines where my house is going
to be built. The common property line we shared had the only
space where they could build a septic system and the area
was parallel to the line. Since the dummy had removed not
only the earlier survey flags but the engineer's flags I knew
the septic field would end up on my land.
The new survey was well worth the money to keep his
stupidity from cost me more money. I swore that if I saw that
they built the field on my land I would hook up the backhoe
and starting digging a trench just on my side of the line. But
it would have been a mess....
Has your lawyer said what you can or cannot do if his septic
field is on your land? I would suppose it has no bearing
what so ever on the easment issue.
I had some stressful issues pop up last week. I was thinking
of what my dear departed granny used to say, "It will get
better in the end." She raised four kids by herself on a
teacher's salary and I'll be danged if I know how she managed.
And in those days teachers really where not paid anything. /forums/images/graemlins/frown.gif
I think my granny got through many a tough time on "It will
get better in the end." Its often all she ever had.

Dan
