I've just got to get my two cents worth in here. It appears I've had the identical problem with my TC45D. I’ve read a lot of the forums and started a thread on this forum. Bottom line. The tractor was returned to the dealer at least 4 times for this problem. On two occasions I was told that the “transmission was replaced”. I asked for and received the actual work order and warranty billing info for the second replacement. So I know something was changed. On the third transmission replacement everything seems to be fine so far. The rest of the fixes, i.e. grease, springs, etc. didn’t do diddley squat. My dealer never argued about my claim. Since it was an intermittent problem he could never duplicate it at the shop. Although the service manager, great guy, did come out to my place one day, after work, to watch me operate the tractor. In my opinion this is a very serious problem, safety wise. And I did point this out to the dealership every time I called to complain. Just stay on their backs and keep pointing out the fact that you have notified them of this problem and your wife is well aware of it ……just in case something happens. It probably doesn’t hurt to mention this to the owner of the dealership and ask him who is his insurance carrier. All of this in a friendly conversational tone. Joe this is the very reason that I said I was skeptical in an earlier post. I doubt if any spring kit is actually going to take care of the sticky pedal problem but I'll give them the benefit of the doubt. They currently have my tractor and they are most welcome to take their best shot at repairing the problem at hand. Beyond that I'll start writing letters and filing complaints to document my safety concerns.

I do hope for the best.

Here is what I know to date.

My TC-40D was returned to me today, but not until after dark. I rolled under it with a flashlight and the return spring is about 4X larger in diameter than the stock one. There also appears to be a new mounting/tensioning plate for the return spring but I can't be sure until I get it in better light tomorrow. The operation of the HST pedals appears to be much smoother and it actually takes less foot pressure even with the larger spring. I tried out the cruise and the magnet is still strong enough to hold a constant speed. It's too soon to tell if the sticky pedal has been repaired but I'll give it more of a workout tomorrow and let you all know more then.

I tried unsuccessfully to pry the part numbers out of my dealer but he wasn't giving them out to me and they were not on my receipt. I don't think he wanted me posting the numbers at the TBN site, as he is aware that I am a member. He did tell me that NH Dealers had access to a "product improvement book" that listed this modification in detail. He said that it will be done on a need-to-do-basis. He also said the new DA model NH comes with this improvement so the part numbers shouldn't be too awful hard to obtain. So, who's got a parts breakdown for a DA?

What if you need to replace those parts 5 years from now. They're not the original part number and you don't have the new numbers. That's a dealer I'd avoid like the plague.

On the class 2 boomers a spacer has been added to either side of the return spring to increase the spring force part number sba026109105 became available Jan 05. On the Class 3 a heavier return spring part number 87300242 with 20% more return force is being used on the new DA model and can be retrofited to the older models by replacing the pivot shaft which is part number 87300017.

I'll check my manual and see if it lists that part #. As for crawling under tractor, can't today, it's FREEZING outside right now and there's a few inches of new snow. But will check asap.

Another question if I could... does the new pivot shaft replace the original part # 86573782 ( ref # 26 on parts page 03.03 ) ??

I suspect they've lengthened the arm to get more lever force.
