Hunting question (Tennessee)

Eye opening.. When I originally read it back in 2005 when I moved into this state it defined that you could retrieve animals that made it to property that you did not have permission to hunt on. Good thing I have zero requirement to worry about that anymore ;) besides if I did, I would still talk to the property owner for permission and if ever denied I still would not allow that animal to stay there fallen. I would just call the game warden.. He can go anywhere, anytime as one of my neighbors discovered.
I like to sit down with the latest book of regulations at the beginning of each season to see if anything has changed.

I also have learned to keep a copy of fishing regulations in my tackle box for when I go fishing with friends... on more than one occasion it's been the final word, ending discussions of whether a body of water is open or not.

. I have 10 acres of rural land with a cabin on it. There are several people trespassing to hunt there. I have even found tree stands left there. If I lived their full time I would go through great trouble to ruin their hunting like shooting every morning, but since we don't live there it is not worth stirring up trouble.

In NYS, it is illegal to purposely disturb or hinder a hunter or fisherman from their legal activity. I don't know what it is in your state, but you should be careful if you follow through on that statement.

Yes, but if they are hunting and fishing on his property illegally without permission, its probably not going to matter. We have the same law in Indiana. Doesn't apply to trespassers.

I am not against hunting. In fact I bought hunting license first time in my life for this year season but so far didn't shoot anything. I plant food plots, place mineral blocks and feed corn to the deer for years. We spent substantial amount fencing about 8 ac where we planted several thousand trees. I can tolerate or even appreciate when hunters find and retrieve shot animal from my property. I hate when they don't bother to do so. Bow hunters are the worst offenders (I think) because they take risky shot and only harm the animal. I find one or two dead deer on my property every year after hunting season or I see "slow" deer with arrow sticking out of it. I have a collection of arrows in my garage. Then we have to call hunters we know to come and put it out of its misery.

I think that is incorrect. From this article...
"hunters must have the permission of the landowner to track or retrieve wounded game on private property."
Hunting on Private Property

It has changed in the last few years, the last time I went hunting the game laws said hunters had the right to retreve downed game. It has been 5 yr's or so/ Ed

You are correct Moss Road, if they are trespassing then they are not in legally hunting or fishing. But if they are on adjacent property and have permission to be there, you can't stand in your backyard and blow whistles, horns etc. In an effort to disturb the hunter.

Tennessee law also says that it is illegal to,

"Hunt, shoot at, chase, or kill any wild animal, wild birds, or waterfowl on public lands or waters while you are within 100 yards of a visible dwelling house unless you have the owner's permission."

That no hunting within 300 feet / 100 yards of a building/dwelling rule is pretty common across multiple states. The TN law says "dwelling house", but doesn't seem to mention other structures. NH applies to residences, barns, and other structures frequently occupied by people. That would include an outhouse in the woods, but not a cat-hole with a log to sit on. It would not include a well-house, but it might include a shed if you spent a lot of time working in it. And hunting in cluster housing/developments is a no-no.

TN law also says, "Don't drink and hunt." So every one of those slobs tossing their beer cans around are in violation of the law, and should be prosecuted to the fullest extent.

your premise is backwards.

if they have commited the crime of tresspas and hunted on someones land ( even leaving stands ).. then there is no assumption their hunting activity is legal. IE.. if they have to break the law to hunt.. they are hunting illegally.

Think about it.

if I walk up and attack you, and you hit me to defend yourself, and then I kill you and claim self defense, them my premise is wrong....

That's why we have to read the new books every year. Same thing happens to me when fishing. New regs, changed regs, etc... :)
