You are correct Moss Road, if they are trespassing then they are not in legally hunting or fishing. But if they are on adjacent property and have permission to be there, you can't stand in your backyard and blow whistles, horns etc. In an effort to disturb the hunter.

your premise is backwards.

if they have commited the crime of tresspas and hunted on someones land ( even leaving stands ).. then there is no assumption their hunting activity is legal. IE.. if they have to break the law to hunt.. they are hunting illegally.

Think about it.

if I walk up and attack you, and you hit me to defend yourself, and then I kill you and claim self defense, them my premise is wrong....

Sound guy, sorry I am not following you? Did you see my follow-up post where I clarified a person trespassing is hunting illegally? My example or point I am trying to make is that you cannot disturb someone pursuing their hunting or fishing activity when they are doing so in a legal manner. (PETA walking through public land hunting grounds blowing whistles, setting off fireworks, etc.)

Even if they are doing it illegally, (trespassing, using a gun during bow season, jacking deer...) I would think it would be better to let the proper authorities handle it rather than on your own.
