Is a Poly Drum legal for fuel?

It's been a while, but I did take a hazardous materials transportation course for work. At the time they taught us that the DOT hazardous materials regulations only apply to "material in commerce". As soon as you, the end user, buy the fuel the rules no longer apply.

If anyone can cite a regulation stating otherwise, I'd love to see it.

30 gallon plastic drums are real hard to come by round here.
Couldn't figure out why till I stopped by a dairy plant the other day.
They get concentrated fruit juices in 30 gallon plastic drums but they can't give me one because the EPA requires the drums be recycled back to the supplier of the fruit juices.
The EPA is getting out of hand & is a real pain.

My supplier put 33 gallon in my plastic drum and 27 gallon in my 55 gallon steel drum yesterday.

Mine won't either but they dropped me off 60 gallons yesterday because they were making deliveries in the area.

Don't have the exact rules but my employer is an end user and we sure as heck have a plethora of hoops to jump through transporting diesel for generators. We don't do it except in emergencies but the rules still apply.

Why not use a properly marked steel 55 gal drum. You don't have to fill it if you don't want that much fuel. How to unload the drum. Easy. Buy two. I get nice ones for $5-6 each. Label them to please the authorities if you think anyone cares.

When one is empty, put it in the truck or on the trailer and go get fuel in it. When you get back just siphon the contents into the other drum you have sitting on the ground where you want it. Now the drum in the truck is light enough to unload with no major struggle.

Too easy? I can probably figure out a complicated expensive way to do it if needed.

The blue one is 55 gallon steel.

5*I pump the fuel into the blue and or white drum in the garage as shown.
These drums are never moved so they are always where I want them.
