dfkrug, I doubt that the insurance company will "total" the tractor even if the frame is bent or twisted. Now if there was drivetrain damage...........maybe. The replacement parts on the tractor itself are really minimal.

I am sure JD has a flatrate guide for the time it takes to replace the frame. We did one on a 35HP 4x4 Branson and I think it was around 20 hours. If you think about it, 20 hours is more than 2 full shop work days. The engine stays attached to the transmission, so you don't have to get into a full tractor split. With A/C and maybe an oil cooler up front, it will take a little longer, but I would not suspect a full weeks labor just for the frame.

My experience with claims adjusters has been positive. Since I used to be one, I realize that they are just doing their job. The money doesn't come out of their own pocket. They just want a well documented file, especially if they have to go to their supervisor for authority.

We recently had a customer who had a tree fall on his tractor. I wrote up a detailed estimate for the adjuster, then I gave him the ACV (actual cash value) appraisal I had worked up, then gave him a salvage bid. He wrote out a check for a new tractor for the customer. Simple as that, and he had a well documented file.

Anyway, glad you were not hurt!

Major bummer, and to happen to such a nice looking tractor.

One thing I'm surprised hasn't come up is any potential damage to castings. There are a couple of threads now with broken castings/tractors where the casting looks to have been cracked for some time before the ultimate break. Wouldn't it be a shame to have your tractor all fixed up and use it for a couple of years then have it break due to a crack from this accident? Can you get the dealer to do some extensive dye penetration checking or something to verify there are no hidden cracks? Should all be part of the claim.

I sure would be leary. When cars crash, it's all very ductile sheet metal that takes the impacts. Most of the structural elements on a tractor are much more brittle castings.

Hope all works out, this can't be much fun for you.

Everyone ok, tractor replaced, I had three hours on this one when the mercury did it in....

David, was the driver cited for failure to maintain control? What was his insurance company stance on who was liable since you were crossing the road? As of now the Suburban drivers insurance company, Liberty Mutual is taking the stance that I had no right to be on the road plowing snow since the State of West Virginia has adequate snow removal equipment. Technically I was returning home at the time of the accident and had my blade up when I was hit by the Suburban.Even though the Suburban driver lost control he was not cited by the Sheriffs Department. LM's stance is since I had no right to be on the state maintained road I am liable for the accident. Hmmmmmmm, I am sitting stationary and a Suburban skids out of control for 205 feet and its my fault. I must be missing something here. I was taught that no matter what the weather and road conditons where I was responsible for maintaining control of my vehicle. I am going to ask for a written statement from the insurance investigator to see why she made the decission she made.

Glad you got another tractor and escaped any injuries. You took a pretty good hit since it was the front of his vehicle against the side of your tractor.

Dirt, don't let Liberty Mutual push you around, I am involved with a claim with them and they've been ***** footing around for three months now. Funny thing is, I had heard at one point in time they were an upstanding insurance company. Guess times change.

I would be digging out my driving license manual or checking the state laws on farm equipment. I believe arkansas mentions something about farm equipment being temporarily on the road. I think they are talking about not having to have license plates if I remember correctly but the important thing is that they are implying consent to be on the road for a short period of time. I would be suprised if there were a statute that prohibits you from assisting the highway department in cleaning the roads leading to your house. In my county the actual statute about taxes mentions that if there is not enough funding in millage for road repair the county can call on every able bodied man in the county to assist with road maintenance. That arguement is like saying you dont have a right to drive on the highways in major cities because they have a bus system. This is just an example of an overly zealous adjuster trying to keep from paying you the amount of money you are owed. I am sure the state police had warnings out telling drivers to stay off the roads. Maybe her insured was in the wrong to be on the road also. I try to be honest but when someone starts playing games to cheat me all bets are off. I am afraid if I was in your shoes now would be the time when I would start talking about my back hurting a lot since the accident. If the police were called now is the time to get a police report if you have not done that yet. Dont be suprised if the adjuster does not make you hire an attorney. Some of them seem to feel like they have done something important if they can keep their company from paying an honest claim. Notice I said some of them there are a lot of hardworking honest adjusters out there but like every industry there are the bad apples.
