Jibberish

Bill, I used to have one of those PC programs called "It's Legal" and I did my Dad's will on it and my sister's will on it before they died, and had no problem with the courts at all. However, I've since discarded it. It worked well for them at the time, but there are a couple of things we need that the form simply did not provide for. There very well may be newer ones that would do what we want, but I don't know which ones and would hate to buy something I couldn't use.

Did you not get the legal program when you purchased turbo tax? It seems quite adequate for most situations.

Buck,

... the purpose of said “jibberish” being to obfuscate the intents of the respective parties while also simultaneously and more (or less) succinctly delineating the rights and obligations of the seller and\or the buyer for the protection of all (or some) of the participants in the contract.

Whereas, having set forth the grounds for the above-referenced jibberish (aka legalese), you now owe me $500.00 (U.S.).

My wife and I had an attorney draw up a simple will for us...

I die, she gets everything.
She dies, I get everything.
We both die, everything gets put in a trust for the kids' care and education through college. A trusted relative gets custody of them while they are minors and administers the trust until the youngest turns 23. Then they split what is left equally and the trust is disolved.

I'm pretty sure it was around $200.00.

How long ago, David. We had such will done by an attorney 28 years ago, when the kids were 8 and 11 years old and I think it cost me $125. Of course, I understand about the inflation since then, but the wills will be much simpler and shorter now, too.

Bird,
my wife has been looking into updating our wills too .... and she's been checking with the evildoers at AARP. Unfortunately, the nearest "recommended" lawyer is an hour away ... but they certainly have great prices (all the lawyers they listed for us with 150 miles) .... $75 for a simple will (no at-home kids) and $100 - $150 for wills slightly more complicated.
So ... assuming you're a member ... you might want to check the mag and call the 800 number ...

Thanks, Pete, I didn't think about that, but I've been an AARP member for 15 years. And I'd drive 150 miles for that much difference in price. /forums/images/graemlins/tongue.gif

A suggestion to all....

You can also try the PrePaid Legal service. It will cost you $25 bucks a month or so and it includes a will and the powers of attorney just in case. We have the service and it has paid for itself. Additionally, the CFO managed to get caught speeding a year or so ago and the service represented her at the hearing. No cost and she got out of the ticket and points.

I will point out that after making contact will a PrePaid Legal rep, they will try to get you to become an associate. Be prepared.

What happens to the $2000 if you default because of lack of financing, or just because you want to back out. Or because you find out there are environmental problems? What if the seller backs out? What if you can't close on time your fault, or the seller's fault? Who is paying for the title policy? Who is paying the legal fees. Who is paying for the survey?

I recommend you get one of those standard contracts that addresses most of this "jibberish", so that both parties know what the deal is.

Pete, I contacted one of the AARP attorneys and have an appointment with him later today; $175 for both wills, plus another $140 for both medical and financial powers of attorney for both of us.
