I'm sure the people that are getting sued for the online music thought the same thing. I don't think anybody is immune from anything anymore even if it is in direct contradiction to the constitution or law. Some slick willy lawyer will always find a loophole. /forums/images/graemlins/mad.gif

My point was that freedom of speech is not absolute. It doesn't allow someone to yell 'fire' in a theater (the usual example) nor does it allow people to slander/libel someone else.

I found myself in partial agreement with CW's previous post several months back about his backhoe claim. I did not download the file the warranty/liability statement, but would find the ability of Kubota to use their discretion solely to determine if a 3rd party implement the reason for the Kubota tractor failure a bit like Colonel Sanders guarding the chicken house. I have all 3rd party implements with the exception of the loader as many of us do. While my information gathering on the subject has yet to come across any Kubota owners with even the slightest occurence of these problems, I do realize they can and do happen. It will be nice to know where you stand when or if they do. I hope CW gets everything worked out well. I realize the sacrafice many of us make to purchase any tractor brand and certainly feel fair treatment is due to us all.

P.S. even in Kubotas brochures we see pictures of 3rd party implements so it tells me they are not discouraging the use of such implements.

Downloading of on line music isn't the same thing.... People that download music are taking a copyright product without paying for it. Suggesting that a person be careful and read the warranty and also recommend that they purchase a new, used or Grey market tractor of another brand other than Kubota isn't taking anything from anyone without payment. It is stating an opinion of the person making it. You are free to determine the validity of their recommendations. Yelling "fire" in a crowd is tantamount to starting a riot and is not protected by the freedom of speech amendment to the constitution. Calling a police officer a "pig" is a example of freedom of speech.... you can do it and there is nothing that they can legally do to you. Pornography is protected by the same amendment and is interpreted as freedom of speech even though some might not approve of it. There are a lot of things that fall into this category that many people don't approve of, but if we are to have freedom, then that freedom requires tolerance of others even if we don't like what they have to say.

P.S. Even installing tires that do not have Kubotas blessing voids the warranty.

Not if you read whats been posted. See junkman for example. I thought he explained it quite well.

I didn't mean it was right or wrong. It doesn't matter anymore. My point was those people didn't think there was anyway they would be held liable either. Right, wrong, good, bad, doesn't matter. If there's a way a lawyer will find a way to sue somebody.

I guess then Kubota's equipment can't handle other impliments. Maybe the designers should go back to the drawing board so thier equipment can handle other equipment.
