Do not allow it, it will come back to bite you in the rear eventually. Here are two stories.

Years ago my brother and I were visiting our mom on Lake Flathead, he would make big rollers with the boat and I would jump them with the PWC. Well I crashed the one time and needed nine stitches. My health insurance company tried to sue my Boat (PWC) insurance company. Luckily it was a $1,000 deductible and less than a $300 ER visit. So it ended real quick.

A friend has two kids, they buy a trampoline. Neighbor kids come over to play also. An adult is always present when kids are playing, neighbor kid takes a fall and breaks his arm. Broken arm kids parents 'hey no problem, kids get hurt.' But broken arm kids insurnance company files a claim against my friends homeowners insurance. They then pay a $1,000 deductable, and get rid of trampoline.

Do it only if you want his grand kids to own your property once they get hurt - of course they won't enjoy it much being a paraplegic in a wheel chair and all....

When we got the new house insured the company wanted to know if we had a trampoline. A trampoline causes a lot of problems for everyone.

I have issues with my back. Never thought I would be one of THOSE people but I am. Its not bad so I am much better off than many so I'm thankful. As long as I don't do the things that can hurt the back I'm generally ok. There is almost always a slight discomfort but its just a nagging thing. But every once in awhile the back will act up and I'll go to the Bone Cracker for an adjustment.

And a couple times a year, a company affiliated with the insurance company sends us a letter asking us to fill out a form. The form asks how the injury happened, was someone else at fault, what is injured, etc.

I won't EVER fill that form out. I figure it will get dumped in a database somewhere and most likely they want to sue someone.

While my opinion is worth no more than the next guy, at least consider this. I spent 20 years of my spare time bouncing around on a dirt bike. I went through all the hassles of finding a place to ride. (Dad wouldn't even let me ride on his farm) It's a bummer finding a good, safe place, especially a place where you can turn kids loose. Property owners don't want the noise, the liability, or the occasional invasion of privacy that goes with opening your land to "strangers". After all those years of hunting for riding areas, if someone was to ask for permission to ride on my place now, they'd get the same answer I usually got......GO AWAY!

Let's say you do allow these kids to ride there. A few neighbor kids see them. It's now a "public riding area" in their minds. You have created/allowed an attractive nuisance. The action of NOT prohibiting riding can be misconstrued as giving permission in certain situations.

And while my opinion and that of many others may be less meaningful, ask your INSURANCE CARRIER how he would respond to kids being allowed to ride on your property. Safe bet he won't give you 10 good reasons to allow it ;)

Say yes and you open up the door for whatever happens. Even a stern NO won't assure you'll never be sued.

It is ovious that YOU have never been put thru the wringer in court, or walked in those shoes:rolleyes: :rolleyes:

I have had lawyers begging me to sue when I was shot in an accident, yet they could not understand the word (accident)

And yes, I have been "thru the wringer" a few times - I was divorced a number of years ago, and if you run a small business sooner or later you wind up in court, either as plaintiff or defendant........

But I don't want to hijack this thread any further, we all have our different opinions and experiences - I would not care to voice my opinion of politicians for example, so we all have our nemisis............

In addition to the liability problems you may face if ANYONE gets injured and you gave permission, there is also the fact that 4 wheelers can and do tear up pasture land pretty badly when the riders start doing wheelies, donuts, etc. which they will do, sooner or later. I'd say absolutely "NO", DO NOT allow them to ride on your property.

If those kids trespass and ride on your property anyway, the only legal obligation you'll owe a trespasser most likely is to warn them of dangers of life and death, such as an open, large hole in the ground, now completely covered with grass and weeds, or rotted boards, and not marked off in any way.

I was thinking of this thread when I saw this story in our local paper:

"A tragic accident claimed the life of 13 year-old Ty Hunter Allert, II Monday night. He was riding his 4-wheeler near his home on CR 308 in the Blue Community West of Lexington when he apparently lost control of it, rolling end over end. A short time later, his father found him with injuries that appeared to have caused his death."
