Actually you're both right ,and the answer is:
CHOCK IT AND BLOCK IT !!!!! ALWAYS !!!
As far as the safety brake away switch, in NYS it must be working and must lock the wheels when pulled . It is resettable, if it isn't get a new one that is, they 're only about $15. ( JC Whitney carries them)
also in NY and other states the law for commercial vehicles is you must carry chocks and USE them. Many companies and muncipalities it is grounds for dismissal if you don't use them.
