I woke up last Sunday morning to 8 horses on my pole barn green field. They looked like they were really enjoying the grass and clover I planted for the deer and turkey.

I have never owned horsed in my whole life.

After a great breakfast that my wife made, I called our next door neighbor (about a mile away) and he and his wife came over and we had a good conversation for a half hour or so before they went and got their horses back over on their side of the fence.

We didn't try to ride them but we did take some pretty good pics of them.

Just an observation....The OP warned the neighbor lady to not approach his dog...She ignored him and trespassed...The neighbors Chicken also trespassed...so I guess the OP should just take it on the chin and apologize to his neighbor for even existing....:2cents:

That's true Bob. I think most people here are trying to help the OP distinguish between "who's fault is it" and "who's going to pay for what may happen."

A dog that cannot be trusted to obey is in control of the owner. That situation needs to addressed either by training if possible, or by controlling the dog's tendencies and opportunities, such as with a fence.

I'm sure it is not the OP's preference that his dog bites someone who didn't listen to him. That lady may not understand dogs, but that is not going to be a successful defense of a dog bite, especially where no threat or malicious intent is involved on her part. What is the situation if the OP is not there to say stay away from our dog? No one gives much sympathy to the owner of an out of control dog that bites regardless of where and how it happened. That's just reality.

It isn't my intention to pick on the OP or make him feel bad. I'm giving the best advice I can to help him avoid trouble down the road.

Now, let's talk about the noise polluting dirt bikes. :laughing: The neighbor ought to be willing to at least tone it down with a proper muffler. Anyone who can afford to make that much noise can afford a muffler.

Yup... I tend to agree. While the person bitten reasonably should have stayed back. and the chicken is a non issue really as it likely DID venture over boundries.. .. this puts the real onus on the neighbors... but the reality of the situation with respect to liability and litigation.. is the op has a dog that may cause him financial problems even if he technically is in the right.

Kinda like J walking in traffic. pedestrian technically has the right of way.. though he may end up being 'dead right'

I wouldn't have taken the chicken over to their property.... odds are they may not even notice one is missing. Then you could have taken a house-warming gift over as an apology for the dog bite.... nice pot of homemade chicken soup ;)

Not to hijack, but this is along the lines of an issue I'm having with my neighbor's dog. He got a dog last fall that was full grown. It is a larger spaniel of some sort, no doubt a bird dog. I love dogs, but he does not keep this dog penned or fenced and it runs free. It is a nice dog; no issue there, but I have chickens and ducks and it pesters the crap out of them. I am missing 2 ducks. Found one dead in my pond. Can't prove either are due to the dog, but he comes across the road regularly and chases them and jumps in my pond. I haven't seen him catch one yet and haven't made a big deal about it other than running him off if I'm around to do so.

Not too long ago my cat came running around the side of my house. I thought that was odd until the dog rounded the corner too. My cat recently had kittens. Yesterday while mowing the grass in my front yard, the neighbors dog was running across his front yard with a kitten dead in his mouth. I'm guessing it's one of mine.

I have great relations with my neighbor, but am really getting tired of this. When he first got the dog, I told him it's a bird dog having owned several spaniels myself over the years.

He mentioned about putting up a pen or electric fence or something but has not done this. Frankly I don't want to fence myself in to keep his dog out. On the other hand, though, there is nothing in my yard to keep my cat from roaming to his yard although I've never seen my cat over there. I don't want to be two faced and certainly don't want to strain our relationship, but this can't keep going on. I rarely let my chickens out of the coop to free range anymore unless I'm around in the evenings to keep an eye on them. My oldest bird went missing about a month ago now. Once again, can't pin it on the dog, and it could be hawks or anything, but I do have my suspicions based on him chasing my cat and ducks regularly.

Thoughts? Advise?

I'm another proponent of chain link fences...keep your dog on your property.

If your neighbor wanted to sue you, you'd lose...simple as that. You'd also lose your dog, most likely.

When we bought this place in Bethel, the first thing we did was to fence in (chain link) the back yard area...mostly, in our case, for the safety of our dog. But, it keeps neighbors out too. We're very friendly with our neighbors and they're welcome here anytime...but I'd still have the fence.
