As evidenced by the posts in this thread, burning regulations differ across and within states. For example, NC has state-level statutes governing outdoor burning. Some counties and municipalities within the state impose additional regulations.

Steve

Years ago, gracious, maybe ten years back, :confused3::shocked:, my drive to and from work took me through what HAD been a rural area. However, huge developments had moved into the area and hundreds of acres of land was being cleared to grow houses, town houses and apartments. One morning I stopped at an intersection and there were huge burn piles on one side of the road which is in one county that follows state regulations. The other side of the road was in a different county with its own regulations that banned burning and required chipping. So, one side of the road had huge burn piles going while the other side of the road had tub grinders grinding away.:laughing::laughing: I really wish I had had a camera. :D:D:D

In NC that burn pile would be a problem because of the construction debris and one will be in a world of hurt if there are tires found in the burn pile. Steel cord don't burn and if the fire marshal see some one can expect a fine.

The pile is big and the brush is small, which means when the fire gets going for the first hour or two, the flame will be huge and intense. Wind is gong to blow into that fire as the O2 is consumed. I have burned a few piles a bit shorter, and with similar sized brush, but no construction debris. It was not fun for the first 60-120 minutes. I did not have any problems but the fire is dangerous at that point and if the weather *** prediction *** is wrong, and a wind kicks up, there can be problems. My neighbor lost control of a small burn, much, much smaller than the OP's burn pile and the Forest Service came out with a team including a bull dozer to put out the fire. Not fun for him at all.

I try to make my burn piles long and low. If I can, the pile is on a slight hill so I can start the fire on the uphill side so the fire has to burn downhill which helps keep the flame spread slow.

Dan

What? You are a burn permit lawyer now?

There are numerous legitimate reasons why a person needs the township to follow their own burn procedures in a timely manner. The weather is at the top of those, but people do have schedules and other commitments too. The fire must be attended and that will take the better part of a day. For that matter the Fire Chief may know that part of his force or equipment is not available on a given day.

It makes no common sense if I would go and ask for a permit to burn and request the required inspection, that someone shows up (maybe, sometime) in the next 2-3 weeks. That meets no useful service standard. Some of you are beating Bill over the head with rules he didn't create and is trying to comply with. I seriously doubt that Bill filled out the permit and asked, When are you MORONS going to inspect my burn pile?

Let's not confuse the issue of making government work with the issue of the nature/quality of the burn pile. Working government means someone shows up, if that is the process, and either approves or denies the burn. If denied, that is an excellent time for education on the matter. Fire Chiefs work to prevent fires too.

Bottom line, don't make up rules if you aren't willing or able to execute them.

Verbosity aside, he never answered the question.

He never said how long the permit is good for once he gets it. He never said how long they told him it would be before they would come out.

Verbosity aside, he never answered the question.

If they didn't tell him when they would get there, or call and say they can't make it, they don't have much of a process. I know that's all Bill's fault. The more burn permit lawyer  questions you pose, the worse the township's execution of their rules looks.

I asked for an inspection that day as there was supposed to be no wind today...and it's a sunny, 15 degree day without a breath of wind so far. Still waiting for the useless local fire department to send someone out to inspect the pile and give me an okay to light it off.

The above was posted at 3:27 pm.

It is composed of 100% brush and lumber and there is NOTHING in it that violates the burning regulations....NOTHING!!!
Comments are welcome.

Looks to me like there's a lot of things there that violate regulations. For starters, there's something large, painted black. I don't know if there's anywhere that allows burning painted materials.

The OP should take his complaints directly to those who can do something about it, without the 'stupid and moron' comments. Explain his concern and ask if there is a timeframe the burn permit inspection/approval process falls into and what is the process. Ask what the landowner's expectation is regarding how long he/she is supposed to wait on approval. If it's a we'll get to it when we can or do, then he could ask if they could post the regs where people could see/read them. And he could inquire why the regs are the way they are so he could come to understand if there is some reasonable explanation beyond the town wanting to make his life miserable just because they can if they want to.
