You are trying to start something with me MossRoad...I am not going there. :(

You are reading too much into my replies. I am not trying to start something with you. I think if we met face to face we would have a good conversation. Sometimes things do not come across in text as they do in spoken word, as I cannot see your face and you cannot see mine, and therefore, neither of us can "read" the other's intent.

If it would have been me, I would have talked to the person that put up the fence even if my wife was with me. Maybe he has a spouse and my wife and she would become friends. That's the way I look at life. We have 7 neighbors and I only wish one of them would go away. I generally get along with most folks pretty well.

I then read that you talked to the owner, not the renter, and resolved the issue, so I wished you well.

I also noted that you(and others) mentioned damage to the trees that you felt needed to be addressed. As I have been raising a stand of veneer timber for the past 23 years that I will be leaving to my children, I am curious as to how you are going to deal with the damage to the trees. I suggested you contact a forester to see if there is, indeed, permanent damage to the trees. A good resource for that is your state agency. Hope that helps.

Are we clear on my intent now? I wish you well. Good luck with your new neighbor. Good luck with your trees. Happy tractoring, etc...

OK MossRoads....I only add this to offer you some advice. Never take your wife into an unknown situation. Never assume all people are nice, reasonable people. This is Rural Georgia...I venture to say it is somewhat different than where you live...I'm just sayin' Thanks for clarifying...:)

I served in the Marine Corps with a guy from Macon, Georgia. He would tell stories about his grandfather and the neighbors fighting over fencelines and trespassing.

The end result was his Grandfather being shot to death at the gate to his property. No suspects that the law knew about. My buddy said he would take care of it. I don't know if it's a regional thing about fences and blood fueds.

I side with Brin.. never a good idea to go onto some else's property especially with a possible confrontation brewing and 300 foot off of the road.. BAD idea.. good way to get shot and dumped in a hole.. There are lots of meth makers in the world. And they don't take kindly to strangers. and they might just put up a haphazard fence to keep out the curious.. I sure as heck would not have went up to that house. Moss, maybe where you live, everyone is "nice" but not where I live. The only way I would have went to that house is armed.. and THAT is a bad idea too. No Brin did the right thing, by being cautious and handling it the way he did. Some might say I am paranoid, I say I am not going to go around in condition white. There are a lot of bad people in this world. my 2 centavos.

So the Mrs. and I and our dog went out to our farm this morning...drove down our road , checked our lake and pastures and we were driving back down our road to leave when my wife said " What is that fence doing over there ? " I looked and there was some field fence installed coming from the road next door clear onto our property toward the front acreage and continuing in a zig zag fashion taking about 3/4 Acre and then tying back into a gate on the road next door....Somebody had fenced in part of our property...

The house and 6 Ac. next door has been for sale so I called the Real Estate agent and told her about it...and she said..." Oh no...that must have been the new tenant ...we just rented it..." I told her to get the new tenant to get the fence down today and all fence staples that were driven into our trees up , out and off my property or I would be calling the Sheriff and would bill the tenant for the cost of removal and they would be charged with trespassing and criminal damage to property..

Just hard to believe how stupid some people are....So anyone out there...be sure and drive your property often...there is just no telling what you will find.

Around here, the property owner would have pulled into the the tenant's drive and blowed the horn. When the tenant came out, the property owner would have rolled down his window and laid his 357 Magnum across the truck window (not pointing at anyone) while telling the tenant that you have 1 day to get that down, steeples pulled or "else"! First off all, I'm glad this got resolved peacefully.

Secondly .....

holy cow. How valuable is this (or any other) 3/4 acre of rural property? Is it really worth a fist fight? A gun fight? Murder/manslaughter?

Brin - I promise I don't mean to be picking on you, but when I read the original post, it came across to me as if you were extremely upset and willing to be extremely hostile, rather than give the perpetrator the benefit of the doubt. I'm not saying that everyone deserves such, but I do tend to lead with the carrot rather than chase with the stick. I see nothing wrong with the manner in which you handled the situation (calling the Realtor and such), but I took you as being pretty torn up about it in the OP.

Neither here nor there. I'm glad that my neighbors (of which I have 5 or 6, depending on how you count owners and tenants) pretty much get along and don't have issues like this. Of course, my property already had existing boundary fences. If I were to discover that one of those were moved, I'm sure I'd contact the neighbor.

Good luck and take care.

If someone encroaches on my property, it will be promptly dealt with, one way or another. Thankfully it's never happened, probably because my property lines are clearly marked.

Fair enough. There are some places around here I wouldn't go either, let alone take my wife. Got to watch out for the significant other.

Dollars to donuts the realtor represented the property to the new tenants as much bigger than what it was to get the sale, probably not knowing the tenant had plans of his own to run fencing.

"IF" that new tenant knew darn good and well where the PL's were I fear your not done w/ his antics.

Perhaps get some game cameras that take pictures w/ movement around the property now and c what u can c.

If I had inadvertently put up fencing on another's land I am SURE I would force a meetNgreet to APOLOGIZE and offer whatever I could in restitution. Lack of this says volumes IMO.
